CITY COUNCIL RESOLUTION NO. 92-74
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA APPROVING AND AUTHORIZING
EXECUTION OF AN AGREEMENT FOR CONSTRUCTION
OF PUBLIC IMPROVEMENTS
WHEREAS, the La Quinta Redevelopment Agency the Agency")
is in the process of implementing the Redevelopment Plan for
the La Quinta Redevelopment Project No. 1 the Project")
pursuant to the provisions of the California Community
Redevelopment Law California Health and Safety Code Section
33000, et seq.); and
WHEREAS, in furtherance of the Project, the City Council of
the City of La Quinta the City") desires to enter into an
Agreement for Construction of public Improvements the
*`Agreement") with the Agency and the Coachella Valley Water
District the District") under which the City will install and
construct certain street, utility and other public improvements
and facilities the Improvements") to serve the Project;
WHEREAS, pursuant to the Agreement1 the Agency would pay
the City for all costs of such Improvements by monies which the

Agency has obtained or would obtain from the issuance and sale
of tax allocation bonds by the Agency and the District would
pay the costs and expenses of the sanitary trunk sewer
facilities according to the terms of the Agreement; and
WHEREAS, the City Council desires to proceed with the
construction of the Improvements referenced in the Agreement;
and
WHEREAS, pursuant to Section 33445 of the Health and Safety
Code, the Agency may, with the consent of the City Council, pay
all or part of the cost of the installation and construction of
any building, facility, structure or other improvement which is
publicly owned either within or without the Project Area, if
the City Council determines that such buildings, facilities,
structures, or other improvements are of benefit to the project
area or the immediate neighborhood in which the project is
located and that no other reasonable means of financing such
buildings1 facilities, structures or improvements are available
to the community; and
WHEREAS, the City Council hereby finds and determines that
the construction of the Improvements referenced in the
Agreement will be of benefit to the Project Area in that the
public health, safety1 and welfare of the inhabitants of the
Project Area will be promoted by the provision of the
Improvements; and

^#B WHEREAS, the City Council finds and determines that, based
upon the report prepared by staff, there is no reasonable means
of financing the Improvements reasonably available other than
the payment of construction costs by the Agency and the
District;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA
DOES RESOLVE AS FOLLOWS:
Section 1. The City Council hereby determines that the
Improvements are of benefit to the Project Area and that no
other reasonable means of financing such Improvements is
available to the community.
Section 2. The City Council hereby approves the Agreement,
in the form attached to this resolution, and the Mayor and the
City Clerk are hereby authorized to execute said Agreement on
behalf of the City Council.
