CC Resolution 1994-076^!G RESOLUTION 9*76 A RESOLUTION OF THE CITY COUNCIL OF ThE CITY OF LA QUINTA, CALIFORNIA CERTIFYING A NEG*VE DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL ASSESSMENT 94-281 PREPARED FOR ZONING ORDINANCE AMENDMENT 94-044 ENVIRONMENTAL ASSESSMENT 9*81 CITY OF LA QUINTA WHEREAS, the Planning Commission of the City of La Quinta, California, did on the 27th day of September, the 11th day of Oc(ober, the 25th day of October, and the 8th day of November, 1994, hold duly noticed Public Hearings to consider proposed amendments to Chapters 9* 145 and 9.146 of the La Quinta Municipal Code relating to the Transfer of Development Rights; and, WHEREAS, the City Council of the City of La Quinta did on the 6th day of December, 1994, hold a duly noticed Public Hearing to consider proposed amendments to Chapters 9.145 and 9* 146 of the La Quinta Municipal Code relating to the Transfer of Development Rights; and, WHEREAS, said zoning ordinance amendments have complied with the requirements of The Rules to Implement the California Environmental Quality Act of 1970" as amended) Resoluflon 83-68 adopted by the La Quinta City Council) in that the Community Development Department has prepared Initial Study EA 94-281; and, WHEREAS, the Community Development Director has determined that said zoning ordinance amendment will not have a significant adverse effect on the environment and that a Negative Declaration of environmental impact should be filed; and, Wll*AS, upon hearing and considering all testiinony and arguments, if any, of all interested persons des**g to be heard, said City Council did fmd the following facts, fmdings, and reasons to justify certification of said Environmental Assessment: 1. The prcposed zoning ordimce amendinens will not be detrimental to the health, safety, or general welfare of the community, either directly or indirectly. 2. The proposed zoning ordinance amendments will not have the potential to degrade the quality of environment, substantially reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or aniral community, reduce the number or restrict the range of a rare or endangered plant or anirnal or eliminate important examples of the major periods of California history or prehistory. 3. The pr(*sed zoning ordinance amendments do not have the potential to adileve short- term environmental goah, to the disadvantage of long-term environmental goals. The proposed zoning ordinance amendments will not result in impacts which are individually limited, but cumulatively considerable. NOW, ThEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta, California as follows: 1. That the above recitafions are true and correct and constitute the findings of the Council for this environmental assessment. 2. That it does hereby certify Environmental Assessment 94-281 for the reasons set forth in this resolution and as stated in the attached Environmental Assessment Checklist and Addendum, labeled Exhibit A"-EA. PASSED, APPROVED, and ADOPTED at a regular meeting of the La Quinta City Council held on this 6th day of December, 1994, by the following vote, to wit: AYES: Council Members Bangerter, Perkins, Sniff, Mayor Pena NOES: None ABSENT: Council Member McCartney ABSTMN: None City of La Quinta, California AUNDRA L.
