RESOLUTION NO.95-33
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LA QUINTA, CALIFORNIA, CONFIRMING THE DIAGRAM
AND ASSESSMENT FOR FISCAL YEAR 1 995*96
ASSESSMENT DISTRICT NO.89-i
Pursuant to the Landscape and Lighting Act of 1 972)
THE CITY COUNCIL OF THE CITY OF LA QUINTA DOES HEREBY RESOLVE:
SECTION 1. Pursuant to Chapter 3 of the Landscaping and Lighting Act of
1 972, the City Council directed Berryman & Henigar. Engineer of Work for
Assessment District No.89-i, to prepare and file an annual report for Fiscal Year
1995-96.
SECTION 2. The Engineer of Work filed his annual report on March 8, 1995
and the City Council adopted its Resolution of Intention to Levy and Collect
Assessments within Assessment District 89-1 and set a public meeting date of April
18, 1995 and a public hearing date of May 1 6, 1995 at the La Quinta City Council
Chamber, 78-495 Calle Tampico, La Quinta, California. Notice of the public meeting
and public hearing was given in the time and manner required by law.
SECTION 3. On April 18, 1 995, a public meeting for which notice was given
was conducted at which every interested person was given an opportunity to object
to the proposed assessment.
SECTION 4. On May 16, 1995, a public hearing for which notice was given
was conducted at which every interested person was given an opportunity to object
to the proposed assessment in writing or orally, and the City Council has considered
each protest.
SECTION 5. On May 16, 1995 the City Council found that wriflen protests
against the proposed assessment had not been made by owners representing more
than one-half of the area of the land to be assessed.
SECTION 6. The City Council hereby confirms the diagram and assessment as
set forth in the annual report of the Engineer of Work as modified and hereby levies
the assessment set forth for Fiscal Year 1995-96.
PASSED, APPROVED and ADOPTED this 16th day of May, 1995 by the
