RESOLUTION 95.41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA UUINTA,
CALIFORNIA, ANNOUNCING FINDINGS, CERTIFYING A MITIGATIED NEGATIVE
DECLARATION AND AN ENVIRONMENTAL IMPACT REPORT WITH A
STATEMENT OF OVERRIDING CONSIDERATIONS, AND ADOPTING
AMENDMENTS TO THE GENERAL PLAN OF LA QUINTA
WHEREAS, the Planning Commission has conducted duly-noticed public hearings and has
recommended approval of each of the herein described requested Amendments; and,
WHEREAS, the City Council has conducted duly-noticed public hearings on each of the herein
described Amendments and considered the recommendations of the Planning Commission; and,
WHEREAS, each General Plan Amendment request has complied with the requirements of the
California Environmental Quality Act of 1970 as amended), and adopted by City Council Resolution 83-68, in that the
Community Development Department has completed a Draft and Final EIR for two of the Amendments and a Mitigated
Negative Declaration for one Amendment and their associated development applications, which have been reviewed
and certified by the City Council of the City of La Quinta; and,
WHEREAS, as said public meetings, upon hearing and considering all testimony and arguments, if
any, of all interested persons desiring to be heard regarding the Amendments, and City Council did find the following
facts to justify the adoption of the proposed Amendments.
GENERAL PLAN AMENDMENTS 94-O4* WINCHESTER DEVELOPMENT GREEN SPECIFIC PLAN)
1. The proposed General Plan Amendment, as requested, is consistent with the goals and policies of the La
Quinta General Plan.
2. The proposed General Plan Amendment designations will replace the inconsistent land use designations on
the project site.
3. The proposed land use designations are consistent and compatible with surrounding land uses and zoning
designations along with approval of Change of Zone 94-077, and Specific Plan 94-025.
4. Approval of this amendment will not result in a significant adverse impact on the environment due to
mitigation measures which will be incorporated into the approval conditions for Specific Plan 94-025, except
where overriding considerations are recognized in conjunction with the Final EIR prepared as part of this
proposal.

GENERAL PLAN AMENDMENT 95.049* TRAVERTINE CORPORATION
1. The proposed General Plan Amendment, as requested, is consistent with the goals and policies of the La
Quinta General Plan.
2. The proposed General Plan Amendment designations will replace the inconsistent land use designations on
portions of the project site.
3. The proposed land use designations are consistent and compatible with surrounding land use and zoning
designations along with approval of Specific Plan 95.026.
4. Approval of this proposal will not result in a significant adverse impact on the environment, due to mitigation
measures contained in the EIR which will be incorporated into the approval conditions for Specific Plan 94.
026, except where overriding considerations are recognized in conjunction with the Final EIR prepared as part
of this proposal and certified by City Council.
GENERAL PLAN AMENDMENT 95-048- CITY OF LA QUINTA JEFFERSON STREET ALlGNMENT*
1. The proposed General Plan Amendment, as proposed by the City of La Quinta, is consistent with the goals
and policies of the La Quinta General Plan.
2. The proposed General Plan Amendment designation will provide applicable land use designation for the right-
of.way.
3. The proposed land use designation is consistent and compatible with surrounding development and planned
development.
4. The EIR prepared for Specific Plan 94.025 and 94.026 enabled the preparation and certification of a
Mitigated Negative Declaration of Environmental Impact for this Amendment.
5. Approval of this proposal will not result in a significant adverse impact on the environment due to mitigation
measures contained in the Negative Declaration which will be incorporated into the approval of General Plan
Amendment 95-048.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of La Quinta, California, as
follows:
1. That the above recitations are true and correct and constitute the findings of the Council in this case;
2. That it does hereby confirm certification of the Final EIR and the Mitigated Negative Declaration for these
General Plan Amendments by the La Quinta City Council.

3. That it does hereby grant final approval of the General Plan Amendments 94-a47, 95-a49, and 95.048 for
the reasons set forth in this Resolution and as illustrated in the maps attached as Exhibits A", B", and C",
attached hereto.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La fluinta City Council, held on this
6th day of June, 1995, by the following vote, to wit:
