RESOLUTION 95-48
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, APPROVING CERTIFICATION OF A MITIGATED NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT FOR ENVIRONMENTAL
ASSESSMENT 93-256, PREPARED FOR GENERAL PLAN AMENDMENT
93-092 GENERAL PLAN HOUSING ELEMENT UPDATE)
ENVIRONMENTAL ASSESSMENT 93-256 CITY OF LA QUINTA
WHEREAS, the Planning Commission, did on the 23rd day of May, 1995, conduct a duly noticed public hearing
and has recommended approval of the proposed General Plan Amendment 93-092; and,
WHEREAS, the City Council, did on the 20th day of June, 1995, conduct a duly noticed public hearing on the
proposed Amendment and considered the recommendation of the Planning Commission; and
WHEREAS, said General Plan Amendment has complied with the requirements of The Rules to Implement
the California Environmental Quality Act of 1970" as amended) Resolution 83-68 adopted by the La Quinta City
Council) in that the Community Development Department has prepared Initial Study EA 95-293; and,
WHEREAS, the Community Development Director has determined that said General Plan Amendment will not
have a significant adverse effect on the envi*oI'*1*r* * t'i*t * ***`tiq'ated Negd-tive Declaration of environmental
impact should be filed; and,
WHEREAS, the Planning Commission has recommended certification of the Mitigated Negative Declaration
of environmental impact; and,
WHEREAS, an Environmental Impact Report has been prepared and certified for the General Plan as
prescribed by California Environmental Quality Act and identifies various mitigation measures to a level of
insignificance and identifies certain impacts which cannot be so mitigated with a Statement of Overriding
Consideration; and,
WHEREAS, pursuant to AB3180, a Mitigation Monitoring Program which is included in the General Plan EIR
which sets forth monitoring and reporting procedures for maintaining the effectiveness of the proposed mitigation
measures; and, which is hereby incorporated; and,
WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons
desiring to be heard, said Planning Commission did find the following facts, findings, and reasons to justify
certification of said Environmental Assessment:
1 The proposed Amendment as mitigated by the Mitigated Monitoring Program will not be detrimental to the
health, safety, or general welfare of the community, either indirectly or directly.

2. The proposed Amendment will not have the potential to degrade the quality of the environment, substantially
reduce the habitat of a fish or wildlife population to drop below self sustaining levels, threaten to eliminate
a plant or animal community, reduce the number or restrict the range of a rare or endangered plant or animal
or eliminate important examples of the malor periods of California history or prehistory.
3. The proposed Amendment does not have the potential to achieve short*term environmental goals, to the
disadvantage of long.term environmental goals.
4. The proposed Amendment will not result in impacts which are individually limited or cumulatively
considerable.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La 1uinta, California, as
follows:
1. That the above recitations are true and correct and constitute the findings of the City Council for this
Environmental Assessment.
2. That it does hereby approve the certification of Environmental Assessment 93.25* for the reasons set forth
in this resolution and as stated in the attached Environmental Assessment Checklist and Addendum,
contained in the files in the Community Development Department.
PASSED, APPROVED and ADOPTED at a regular meeting of the La Quinta City Council held on the
20th day of June, 1995, by the following to wit:
