CC Resolution 1995-051^"H RESOLUTION 95-51 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA DESIGNATING THE COUNTY OF RIVERSIDE DEPARTMENT OF ENVIRONMENTAL HEALTH AS THE UNIFIED PROGRAM AGENCY FOR HAZARDOUS WASTE AND HAZARDOUS MATERIALS MANAGEMENT. WHEREAS, California Health and Safety Code, Division 20, Chapter 6.11 requires that the administration of six 6) specific hazardous waste and hazardous materials management regulatory programs shall be consolidated as a Unified Program; and, WHEREAS, California Health and Safety Code, Division 20, Chapter 6.11 requires that an agency which administers anv of the specific six 6) unified program components shall be certified under a Unified Program Agency by the Secretary of the California Environmental Protection Agency; and, WHEREAS, those unified program components include the requirements of Health and Safety Code Chapter 6.5, commencing with Section 25100, related to hazardous generators and on-site waste treatment; Health and Safety Code Chapter 6.7, commencing with Section 25280, related to construction, operation and removal of underground storage tanks; Health and Safety Code Chapter 6.95, Article 1, related to hazardous material release response plans and inventories; Health and Safety Code Chapter 6.95, Article 2, related to the management of acutely hazardous materials; Health and Safety Code, Section 2s27O.S* relating to aboveground storage tank spill prevention control and countermeasure plans; and Uniform Fire Code, Section 80.103(b) and c), related to hazardous materials management plans and inventories; and, WHEREAS, Health and Safety Code, Section 25509.2 eliminates duplicative reporting requirements by deeming reports filed pursuant to Health and Safety Code, Chapter 6.95, Articles 1 and 2, to have met and fulfilled the requirements of Uniform Fire Code Section 80.103(b) and c); and, WHEREAS, the County of Riverside Department of Environmental Health currently administers regulatory compliance for five of the six unified program components in the City of La Quinta; and, p RESOCC. 148 BIB] 08-20-1998-U01 08:43:33AM-U01 ADMIN-U01 CCRES-U02 95-U02 51-U02 ^"H L I.- L B,. I I Resolution 95- 51 WHEREAS, the County of Riverside Department of Environmental Health, serving as a Unified Program Agency, shall coordinate administration of the sixth unified program component, the aboveground storage tank spill prevention control and countermeasure plans, with the Colorado River Regional Water quality Control Board; NOW, THEREFORE, BE IT RESOLVED by the City Councii of the City of La Quinta that the County of Riverside Department of Environmental Health is hereby designated as the Unified Program Agency for hazardous waste and hazardous materials regulation within, and on behalf of, the City of La Quinta.
