CC Resolution 1995-069^"IL II RESOLUTION 95-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I-A QUINTA, CALIFORNIA, DECLARING ITS INTENTION TO ALLOW THE TEMPORARY CLOSURE OF CALLE ESTADO BETWEEN DESERT CLUB DRIVE AND AVENIDA BERMUDAS ON CERTAIN DAYS AND TIMES BETWEEN THE MONTHS OF OCTOBER, 1995, THROUGH APRIL, 1996, FOR THE MAIN STREET MARKETPLACE EVENT SUBJECT TO CONDITIONS OF APPROVAL OF MINOR TEMPORARY EVENT PERMIT 95-098 APPLICANT: LA QUINTA CHAMBER OF COMMERCE WHEREAS, that pursuant to Chapter 9.216 Temporary Outdoor Events) of the Municipal Zoning Code, the La Quinta Chamber of Commerce applied for and received approval, under Minor Temporary Outdoor Event Permit 95-098, for the MAIN STREET Marketplace event to be held on six Fridays during the months of October, 1995 to April, 1996; and WHEREAS, Condition 17 of Minor Temporary Outdoor Event Permit 95- 098 requires a street closure for each event on Calle Estado, a public street; and WHEREAS, the City Council has chosen the 19th day of September, 1995, to review and hear any public testimony on this request to close Calle Estado between Desert Club Drive and Avenida Bermudas on October 6, 1995, November 3, 1995, December 1, 1995, Februarv 23, 1996, March 29, 1996 and April 26, 1996 between the hours of 5:00 P.M. to 10:00 P.M.; and WHEREAS, the City Council finds the following facts and reasons to justify approval of said temporary street closure: 1. The City Council finds that the temporary closure will not adversely affect vehicular traffic and the business operators along the street because most are closed at the time of the street closure andlor actively involved with the Chamber of Commerce to hold the event for La Quinta residents and other guests; and 2. The Chamber of Commerce has held this event in past years' and no problems have arisen that would negate the City's approval of this street closure; and 3. An encroachment permit can be granted by the City Council to RescpC.135 BIB] 08-20-1998-U01 08:58:43AM-U01 ADMIN-U01 CCRES-U02 95-U02 69-U02 ^"ILResolution 95-69 allow activities on public streets for specific periods if legitimate reasons can be found to allow the closure and safety standards are provided such as traffic barricades and no parking" signs to insure that the public is not *at risk" attending the events. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: Section 1. That the above citations are true and correct and the findings of the City Council in this case. Section 2. The City Council approves the closure of Calle Estado between Desert Club Drive and Avenida Bermudas per attached Exhibit A" on the days and times stated herein subject to conditions imposed by the Public Works and Community Development Departments. Section 3. The City Traffic Engineer, or his designee, can issue an encroachment permit Chapter 14.16 of the Municipal Code) to the La Quinta Chamber of Commerce regulating the closure of the street provided certain traffic control standards and the Conditions of Approval for Minor Temporary Event Permit 95-098 are met. Section 4. No parking" signs will be posted Chapters 12.16 and 12.32 of the Municipal Code) on Calle Estado between Desert Club Drive and Avenida Bermudas. The Riverside County Sheriff*s Department will tow any unauthorized vehicle within this area at the time of the event. SectionS. In case of bad weather, the Community'Development Director and City Engineer are authorized to reschedule the event provided all conditions of approval under MTOE 95-098 are met. Section 6. The City Council authorizes City staff or other assigned safety personnel to close the event if at any time all safety standards are not being met, and thus could jeopardize those persons attending the function; and Section 7. The City Clerk shall cause this Resolution to be posted within 72- hours after its adoption in four 4) public places. Those places shall be: City Hall, the La Quinta Library, the La Quinta Chamber of Commerce, and the La Quinta Post Offi*.
