CC Resolution 1995-080^!I RESOLUTION 95-80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA APPROVING A DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE LA QUINTA REDEVELOPMENT AGENCY, THE DESERT SANDS UNIFIED SCHOOL DISTRICT, AND DESERT SANDS SCHOOL BUILDING CORPORATION WHEREAS, the La Quinta Redevelopment Agency the *YAgen*y*), Desert Sands Unified School District, and Desert Sands School Building Corporation collectively referred to as the District*') desire to entered into a certain Disposition and Development Agreement the DDA*) for the disposition and development of certain property situated within the La Quinta Redevelopment Project Area No.2 the Project Area"); and WHEREAS, the purpose of the DDA is for the development of a School District Administrative Center and necessary public improvements, and the Agency will construct public improvements needed for two fliture affordable housing projects on 48th Avenue; and WHEREAS, the DDA is in the vital and best interest of the City of La Quinta the City") and the health, safety and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local laws and requirements under which the Redevelopment Plan has been undertaken; and WHEREAS, the Agency is authorized to use tax increment revenues to increase, improve, and preserve the cornmunity's supply of low- and moderate-income housing available at affordable housing cost pursuant to Health and Safety Code Section 33334.2 and WHEREAS, pursuant to Health and Safety Code Section 33445, the Agency is authorized to use tax increment revenues to pay all or a part of the value of the land for and the cost of the installation and construction of any building, facility, structure, or other improvement which is publicly owned either within or out of the project area; and WHEREAS, the Agency and the City Council of the City of La Quinta have conducted a duly noticed joint public hearing regarding the proposed acquisition and disposition of real property in accordance with California Health and Safety Code Sections 3343* and 33433; and WHEREAS, the Agency and City Council have conducted a duly noticed joint public hearing regarding the proposed acquisition and disposition of real property in accordance with California Health and Safety Code Section 33679; and 3Oc*.5C BIB] 08-20-1998-U01 11:43:31AM-U01 ADMIN-U01 CCRES-U02 95-U02 80-U02 ^!I L I * I II I Resolution 95-80 WHEREAS, the staff report pertaining to the DDA, which has been on display prior to the joint public hearing in accordance with Sections 33433 and 33679 of the California Health and Safety Code, contains a detailed description of the provisions of the DDA; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of La Quinta as follows: Section 1. The City finds and determines that the Environmental Determination Negative Declaration) prepared with respect to the development of the Site and all undertakings pursuant to the DnA indicates that the proposed DDA will not have a significant effect on the environment and the Negative Declaration was certified by the City. Section 2. Pursuant to Health and Safety Code Section 33445, the City finds and determines that: 1) the public improvements set forth in the DDA to be constructed by the Agency are of benefit to the Project Area and the immediate neighborhood in which the project is located; 2) no other reasonable means of financing the improvements are available to the community; and 3) the payment of flinds for the improvements to 48th Avenue will assist in providing housing for low- or moderate- income persons. Section 3. The City further finds and determines that the DDA provides for improvements which will assist in fliture development of affordable housing for low- and moderate- income individuals which will increase the community*s supply oflow- and moderate- units pursuant to Health and Safety Code Section 33334.2. Section 4. The City further finds and determines that the consideration paid by the District for the property to construct the Administrative Center is not less than the fair market value at its highest and best use in accordance with the plan pursuant to Health and Safety Code Section 33433. SectionS. The City approves the DDA in the form of Exhibit * on file in the City Clerk's office.
