CC Resolution 1995-082^!I RESOLUTION NO.95-82 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA; APPROVING THE MULTI-CHANNEL PROVIDER'S FRANCHISE AGREEMENT WITH COLONY CABLEVISION OF CALIFORNIA WHEREAS, Colony Cablevision of California, a division of Providence Journal Company, Colony") possessed a franchise to construct and operate a cable television system in the City of La Quinta the City") which expired on December 31, 1994; and WHEREAS, the City adopted Resolution No.94-80 on December 20, 1994 which extended the Franchise until March 31, 1995; and WHEREAS, the City adopted Resolution No.95-17 on March21, 1995 which frrther extended the Franchise until June 29, 1995; and WHEREAS, Colony is currently operating without a formal franchise agreement; and WHEREAS, Colony and the City have been engaged for numerous months on franchise renewal negotiations and it is the intent and desire of both parties to enter into a franchise agreement the Franchise"). NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LA QUINTA AS FOLLOWS: SECTION 1. A Franchise to construct and operate a Multi-Channel Service Providers system in the City is hereby granted to Colony. SECTION 2. By approving the Franchise, neither the City nor Colony waives any rights either may have under federal, state, or local law. SECTION 3. The above recitals are all true and correct.
