CC Resolution 1995-092^!I RESOLUTION 9* 92 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA ESTABLISHING A VEHICLE IMPOUND COST RECOVERY FEE WHEREAS, the Riverside County Sheriffs Department acting as the LaQuinta Police Department in**ounds or stores numerous and various vehicles from highways, public property, or private property, in the City of La Quinta during the normal course of duty; and WHEREAS, the Riverside County Sheriffs Department acting as the La Quinta Police Department impounds or stores vehicles pursuant to its authority under the California Vehicle Code sections 22650 through 22669; and WIIEREAS, Vehicle Code Section 22850.5 added by Assembly Brn 481, Chapter 614 Statutes of 1993, became effective 3anuary 1, 1994, specifically authorizing cities by ordtn*ance or resolution to establiih an administrative charge relating to the removal, irnpound, storage, or release of vehicles; and WHEREAS, stolen and embe*ed vehicle victims should b*, e-*empt from service fees for impoundment and release of stolen vehicles; and WHEREAS, situations may arise that warrant the exercise of prudent discretion to forego or excuse the proposed service fee. NOW, THEREFORE be it resolved, by the City Council of the City of La Quinta in regular session assernbled on December 5, 1995, that the following Vehicle Impound Cost Recovery Fee is hereby adopted: Section 1. Pursuant to California Vehicle Code Section 22850.5, the adm*rative fee for the recovery of impounded vehicles shall be sixty dollars $60) and shall be effective upon adoption of this Resolution. Section 2. The victims of stolen or embezzled vehicles shall be exempt from this admm**rative fee when their vehicles are released from impound. Section 3.
