RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA
QUINTA, CALIFORNIA APPROVING THE CERTIFICATE OF
APPROPRIATENESS 96-002 FOR THE REHABILITATION
AND SEISMIC RETROFIT FOR THE HISTORIC KIENER
BUILDING
CASE NO.: CERTIFICATE OF APPROPRIATENESS 96-002
WHEREAS, the City Council of the City of La Quinta, California did on the
4th day of February, 1 997, hold a duly noticed Public Hearing to consider the
Certificate of Appropriateness, prepared for Environmental Assessment 96-334, for
the rehabilitation and seismic retrofit of the historic Kiener Building located at 79-895
Avenida Montezuma; and,
WHEREAS, the Historic Preservation Commission of the City of La Quinta,
did on the 21st day of November, 1996, review and recommend to the City Council,
approval of the Certificate of Appropriateness; and,
WHEREAS, said request has complied with the requirements of the
California Environmental Quality Act of 1 970 as amended), and adopted by City
Council Resolution 83-68 for Environmental Assessment 96-334; and,
WHEREAS, the Community Development Director has determined that
said Certificate of Appropriateness will not have a significant adverse effect on the
environment and that a Mitigated Negative Declaration should be filed; and,
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be heard, said
City Council did find the following facts, findings, and reasons to justify the approval
of said Certificate of Appropriateness.
1. The Historic Preservation Commission recommended approval of the
rehabilitation and seismic retrofit plans for both the main building and the shed
using the Secretary of Interior's Standards for the Treatment of Historic
Properties".
NOW, THERErORE, BE IT RESOLVED by the City Council of the City of
La Quinta, California as follows:
1. That the above recitations are true and correct and constitute the findings of the
Council in this case.

2. That it does hereby approve of Certificate of Appropriateness 96-002 for the
reasons set forth in this Resolution.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Council, held on this 4th day of February, 1 997, by the following vote, to
wit:
