CC Resolution 1997-048^O RESOLUTION NO.97-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CONFIRMING THE DIAGRAM AND ASSESSMENTS FOR FISCAL YEAR 1997-1998 ASSESSMENT DISTRICT NO.89-i Pursuant to the Landscape and Lighting Act of 1972) The City Council of the City of La Quinta Resolves: SECTION 1. Pursuant to Chapter 3 of the Landscaping and Lighting Act of 1 972, the City Council directed Berryman and Henigar, Engineer of Work for Assessment District 89-1, to prepare and file an annual report for Fiscal Year 1 997- 1998. SECTION 2. The Engineer of Work filed an annual report on May 5, 1 997, and the City Council adopted its Resolution of Intention to Levy and Collect Assessments within Assessment District 89-1 for Fiscal Year 89-1 and set a Public Meeting date of June 3, 1 997 and a Public Hearing date of June 1 7, 1 997 at the La Quinta City Council Chambers, 78-495 Calle Tampico, La Quinta, California. Notice of the Public Meeting and Public Hearing was given in the time and manner required by law. SECTION 3. On June 3, 1 997, a Public Meeting for which notice was given was conducted at which every interested person was given an opportunity to object to the proposed assessment. SECTION 4. On June 1 7,1 997, a Public Hearing for which notice was given was conducted at which every interested person was given an opportunity to object to the proposed assessment in writing or orally, and the City Council has considered each protest. SECTION 5. On June 1 7, 1 997, the City Council found that written protests against the proposed assessment had not been made by owners representing more than one-half of the area of the land to be assessed. SECTION 6. The City Council hereby confirms the diagram and assessment as set forth in the annual report of the Engineer of Work and hereby levies the assessment set forth for Fiscal Year 1997-1998.
