CC Resolution 1997-084^"Q RESOLUTION 97-84 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, DECLARING ITS INTENTION TO ALLOW THE TEMPORARY CLOSURE OF WASHINGTON STREET BETWEEN CALLE TAMPICO AND 52ND AVENUE AND 52ND AVENUE BETWEEN WASHINGTON STREET AND THE EASTERN CITY LIMITS ON NOVEMBER 16, 1997 FOR THE LA QUINTA 5K/i OK RUN, 2 MILE WALK, AND 1K KIDS RUN SUBJECT TO THE CONDITIONS OF TEMPORARY USE PERMIT 97-1 51 APPLICANT: LA QUINTA CHAMBER OF COMMERCE WHEREAS, pursuant to Chapter 9.100.140 Temporary Outdoor Events) of the Municipal Zoning Code, the La Quinta Chamber of Commerce applied for and is receiving approval, under Temporary Use Permit 97-1 51, for the La Quinta 5K/i OK Run, 2 Mile Walk, and 1 K Kids Run on November 1 6, 1 997; and, WHEREAS, the City Council has chosen the 21st day of October, 1 997, to review and hear any public testimony on this request to close portions of Washington Street and 52nd Avenue on November 1 6, 1 997, between the hours of 7:00A.M. and 10:30 A.M.; and, WHEREAS, the City Council finds the following facts and reasons to justify approval of said temporary street closure: 1. The temporary street closure is allowed based on Section 1 2.32.080(d) of the Municipal Code which permits the Council, by Resolution, to designated No Parking" areas by signing or applying red paint to the street curbing. Since this closure is temporary, signs will be used notifying people that the road is closed. Additional conditions will be imposed as necessary to regulate vehicle traffic and ensure pedestrian and participant safety. 2. This temporary street closure will have minor impacts on traffic in the surrounding area since there are alternate routes available and Sheriff's Department personnel will be present for traffic control. 3. An Encroachment Permit can be granted by the City to allow activities on public streets for specific periods if legitimate reasons can be found to allow the closure and safety standards Chapter 1 2.1 6 of the Municipal Code, Traffic Control Devices) are provided such as traffic barricades and F. \CITYCLRK\CQUNCIL\PLANNING\Res 97-84 BIB] 09-11-1998-U01 10:24:29AM-U01 ADMIN-U01 CCRES-U02 97-U02 84-U02 ^"QResolution 97-84 No Parking" signs to ensure that the public is not at risk" during the event. 4. Approval of the temporary street closure will not create conditions that may threaten the public's health and safety needs of the community because specific conditions will be imposed as a part of Temporary Use Permit 96-1 30. 5. This temporary street closure which includes use of the Civic Center parking lot for the start and finish of the race, has been held for the last three years and created no impacts. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of La Quinta, California, as follows: Section 1. That the above citations are true and correct and the findings of the City Council in this case. Section 2. The City Council approves the use of the Civic Center parking lot and closure of Washington Street between Calle Tampico and 52nd Avenue and 52nd Avenue between Washington Street and the eastern City limits between the hours of 7:00A.M. to 10:30 A.M. Section 3. The City Traffic Engineer, or his designee, can issue an Encroachment Permit Chapter 14.1 6 of the Municipal Code) to the La Quinta Chamber of Commerce regulating the closure of the street provided certain traffic control standards and the Conditions of Approval for Temporary Use Permit 97-1 51 are met. Section 4. The City Council authorizes City staff or other assigned safety personnel, to close the event if at any time all safety standards are not being met, and thus could jeopardize those persons attending the function; and, SectionS. The City Clerk shall cause this Resolution to be posted within 72-hours after its adoption in four 4) public places. Those places shall be: City Hall in both the indoor and outdoor display cases, the La Quinta Post Office and the case located outside of the Albertsons store in the One Eleven La Quinta Shopping Center.
