Fred Wolff Date: November 4, 1983 Subject: Report on the Town Meeting of November 2, 1983 A little over sixty persons participated in the 11Quality of Life1 town meeting. It was a very diverse group, including a number of senior citizens and a large number of young people. We broke up into six small groups to develop recommendations to the City Council and/or organize into task forces to further explore the topics. It seemed most participants were highly pleased with the meeting, and there was unanimous agreement that meetings cf this type should be provided on a regular basis. It was particularly valuable to have two additional council members and four staff persons participate; they contributed much to the products from the various groups. Attached are two sets of data: 1) copies of the reports from the groups which were presented on large sheets and which I have copied verbatim for presentation to you;and 2) the work- forms which were turned in by five groups. I indicated at the beginning that a couple of topics were per- haps handled better directly by the Council such as law enforce- ment and code enforcement) some other topics were not desired for discussion by the total group. Hence, six reports out of the ten topics. I would like to recommend the following to you: 1) Lets have another goals setting session very soon. Most of the goals we developed over a year ago have been met. Now we could address some of the items which were developed by the groups at the town meeting, as well as others. I would suggest a one-day meeting, away from City Hall. 2) Assure that the six groups keep functioning. Each has a council member or staff person with them. Let us support them and assure their continuance. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA AMENDING SECTION 18.40 OF THE CITYS ZONING ORDINANCE RELATING TO LOCATION AND HEIGHT OF WALLS AND FENCES. The city COUflCIl of the City of La Quinta, California, does ordain as follows: SECTION 1. Section 18.40 of the City of La Quinta Zoning Ordinance Riverside County Ordinance No. 348 which was adopted by reference by this City Council by Ordinance No. 5) hereby is amended by amending subsection c) thereof to read as follows: c) Method of Height Measurement. The height of walls, fences, hedges and landscaping, as permitted, shall be measured from finish grade as defined in Chapter 70 of the Uniform Building Code. In cases where finish grade varies from one face to the other of a wall or fence, the height shall be measured from the lowest point of finish grade. In the event that practical difficulties and hardships result from the strict enforcement of these regulations due to grade problems of abutting street, slope of property, or other site conditions, the applicant requesting a building permit may apply for a variance as provided for in Section 18.27 of this zoning ordinance. SECTION 2. Said Section 18.40 hereby is further amended by adding thereto subsection e) to read as follows: e) As an exception to the provisions of c) above, in cases of retaining walls on the boundaries of lots, where the finish grade varies from one face to the other of such wall, the height of such wall may be increased 50 as to provide a wall height of not more than forty-two 42) inches above the higher point of finish grade, where necessary in order to provide guardrail' protection as to the lot with the higher finish grade. SECTION 3. EFFECTIVE DATE. This ordinance shall bein full force and effect thirty 30) days after passage. SECTION 4. POSTING. The National Electrical Code, 1981, referred to as part of the La Quinta Building Code in Section 8.04.020 of the La Quinta Municipal Code, hereby is amended by adding a new Article to Chapter 1 of said Electrical Code, to be numbered Article l20 and reading as follows: Article 120 UNDERGROUND WIRES Sections: 120-1 Declaration of cause, necessity. 120-2 Definitions. 120-3 prohibition. 120-4 Exceptions. 120-5 Initial obligation. 120-6 Waiver. 120-7 Appeals. 120-8 Nonconformance-Termination. 120-1 Declaration of cause, necessity. The city council finds that the preservation and protection of the health, safety and general welfare of the residents of this city, and the public at large, requires that all poles, wires and associated structures, as defined in subsection B. of Section 120-2 shall not be constructed, placed and installed above the surface of the ground for the following reasons: A. poles, wires and associated structures which are constructed above the surface of the ground are a hazard to the resident and general public in the City of La Quinta because the city is located in seismic zone #4 as defined by the Uniform Building Code. Because of the proximity of the city to the San Andreas Fault, which is eight miles northeast of La Quinta, and to lesser faults, the Banning Mission Creek and San Jacinto Faults, the intensity of ground shaking is expected to be significantly higher than for the general Southern California area. B. Johnson Company, Applicant. Staff recommends that the City Council approve Final Tract MaD No. 13640-2 and accept the bonds guaranteeing the construction of on-site improvements. The area covered by this final map consists of the central lake and open space area. The City previously approved the final for phase one of this development consisting of the model home area. The City Engineer has approved Final Tract Map No. 13640-2 on the basis that it complies with the conditions of approval of the development and that it is consistent with the state and municipal regulations. Usher, City Manager/Executive Director Date: November 14, 1983 Subject: CEQA Guidelines When the City was incorporated, Riverside County CEQA Guidelines were adopted by reference, and recently the same guidelines were adopted for the Redevelopinent Agency. Recent State legislation required adoption of State Guidelines by November 29, 1983. Therefore, we are recommending adoption of the current State Guidelines cited in the accompanying resolutions for the City and the Redevelopment Agency, respectively. Actions taken with respect to the environmental impact report for the La Quinta Redevelopment Project are also in compliance with these new guidelines.
