Consideration of approval of a Tolling Agreement PUBLIC HEARING:
between the City of La Quinta and the Department of
Fish and Game.
RECOMMENDATION:
Approve the Tolling Agreement between the City of La Quinta and the Department of
Fish and Game.
FISCAL IMPLICATIONS: None
BACKGROUND AND OVERVIEW:
The City received a request from Winchester Development Company, L.L.C. Mr. Mike
Rowe) to sign a Tolling Agreement Attachment 1). This Agreement, if approved by
the City Council, would extend by 30 days, the statute of limitations for the filing of
a California Environmental Quality Act CEQA) lawsuit against the City of La Quinta
and Tradition Club Associates, L.L.C. by the Department of Fish and Game.
Condition #97 of the Conditions of Approval for the Tradition Tract Map 28470
requires the Developer to indemnify; defend and hold harmless the City of La Quinta
in the event of any legal claim or litigation arising out of the City's approval of the
Mitigated Negative Declaration; the Conditional Use Permit, and/or the Tract Map.
FINDINGS AND ALTERNATIVES:
The alternatives available to the City Council are:
1. Approve the Tolling Agreement; or,
2. Deny the r quest.
