FISCAL IMPLICATIONS: ACTUAL ESTIMATED COST: $7,500 BUDGETED: FUND/ACCOUNT: Public Works Maintenance & Operations/Contract Services Tree Trimming AMOUNT: $10,000 FY 1994/95 BACKGROUND AND OVERVIEW: Annually, the City contracts the trimming of palm trees in City right-of-ways. This year's specifications for palm tree trimming differs from previous specifications in two areas, as outlined below: 1. The number of trees in this year's specifications are significantly lower than last year's 500 trees this year, 894 trees last year). 2. Pruning specifications for date producing trees have been included in this year's specifications. Since last year's tree trimming program, the quantity of trees to be trimmed have been reduced from 894 trees to 500 trees. One hundred and fifty-two 152) trees are now maintained under a maintenance contract. Two hundred and forty-two 242) have been either relocated or removed as a result of the Phase V Cove)Improvement Project. The trees that were relocated have been trimmed by the contractor and will continue to be cared for by the contractor through the end of this project tentatively scheduled for October, 1994). Both the r&ocated and removed trees have been deducted from ast year's quantity. Next year's quantity w?l be adjusted to reflect the addition of the trees that were relocated and are currently under contractor's care but subsequently will be the City's responsibi]ity. This year's specifications provide different pruning specifications for fan palm trees and date producing trees. FISCAL INIPLICATIONS: None. BACKGROUND AND OVERVIEW: Section 8.01.030 of the La Quinta Municipal Code Attachment 1) establishes a Building and Construction Board of Appeals to conduct hearings to determine the suitability of alternate materials and methods of installation for construction. In 1988, five individuals were appointed by Council to serve on that Board. Since their appointments it has not been necessary to convene the Board on any issue. Of the original five appointees, one has relocated out of the valley, and two others are no longer active in La Quinta construction activities. The Municipal Code specifies that the membership of the Board consist of the following: one general contractor, two architects or engineers, one specialty contractor, and one member of the public who is not one of the foregoing. The Resolution requests that the properties, which are higher in elevation than the BLM lands but below the desert divide", be designated as a National Scenic Area. At the last City Council meeting, Council requested the following information: 1. A map showing the property in question; and, 2. The limitations on mountain bikes on trails within the Scenic Area". The BLM is currently drafting a coordinated Resource Management Plan CRMP) for the Scenic Area. The most significant change to the draft Agreement is that the Airport Authority is no longer just a 1Regional Planning Commission" RPC), it is also an Airport Advisory Council1' AAC) In addition to the administration of specific plans and zoning and subdivision ordinances relating to proposed development of private and public improvements", the Authority also engages in the planning of public facilities, and advises the Transportation and Land Management Agency on airport operations and uses" Section l.a) The major provisions of the proposed Agreement remain the same and are as follows: * The RPC/AAC will be composed of six 6) elected officials entitled to one 1) vote each. FISCAL IPLIC?ONS: None. BACKGROUND AND OVERVIEW: This tract is located in the gated community of Laguna de Ia Paz on the north side of Eisenhower at Washington Street Attachment 1). Originally subdivided by M.B. Johnson Properties, Inc., Newport Beach, the tract has been developed by Roger Snellenberger & Associates of La Quinta. All improvements required of this tract are complete with the exception of decorative concrete pavement at a secondary entrance gate and adjustment of water and sewer covers to match that pavement. The Coachella Valley Water District CVWD) has authorized release of all security for water and sewer except $21,000 for adjustment of the covers. The developer has asked that the requirement for construction of the entrance be shifted to Tract 20052-4, which will be the final tract developed within the subdivision. This would allow construction of the final tract without running heavy construction equipment and loads over the newly-constructed entrance pavement. In a compromise proposed by City staff and approved by the Laguna de Ia Paz Homeowner's Association Attachments 2 and 3), the City would accept improvements to Tract 20052-3 except those associated with the entrance. The City would retain security for the entrance and for adjustment of water and sewer covers until the entrance is constructed. The compromise would leave the timing of the entrance in the City's control in case Tract 20052-4 is not developed in the near future. FINDINGS AND ALmRNATIVES: The City currently holds $347,000 in performance security and $171,200 in labor and materials security for this tract. On June 2, 1992, an agreement for street sweeping services was executed between the City and California Street Maintenance. The agreement Attachment 1) is a two-year agreement, beginning June 2, 1992, and ending June 2, 1994, after which the City has the right to renew the agreement. Staff recently contacted California Street Maintenance regarding their interest in extending the agreement one 1) year. The extension would keep l provisions and conditions of the original agreement executed 2 years ago in place, including the contracted price for sweeping services. On April 18, 1994, staff received a letter from California Street Maintenance agreeing to extend all provisions and conditions of the agreement for a period of one 1) year Attachment 2). FINDINGS AND ALTERNATIVES: California Street Maintenance Company has complied with all provisions and conditions of the agreement over the course of 2 years. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: Since its adoption in 1989, the City has processed only one Development Rights Transfer. This involved The Quarry" project and Lusardi Land. Mr. Lusardi gave an option to The Quarry development for 36 transferred units. These units were attached to the 160 acres of land bought by The Quarry project. The Quarry project developers sought and received a General Plan Amendment and Change of Zone which permitted The Quarry to develop 65 residential units on the 260 acres. This made the 36 transferred units unnecessary. However, Mr. Lusardi recorded the transfer to The Quarry project in order to sell the remainder of the property to BLM. The existing Ordinance does not provide for any retransfer of development rights. In order to rectify this unforseen problem, staff proposes to amend the Ordinance to permit this and subsequent retransfers either to a non-mountain parcel or an individual. The maximum 20% density increase for transfers still govern. Therefore, this amendment would provide another incentive to preserve the mountains by permitting Development Rights to be banked.
