FISCAL IMPLICATIONS: Staff recommends a donation of $500 that can be funded from Legislative Special Project Contingency Account # 101-101-663-000. BACKGROUND AND OVERVIEW: At the City Council Meeting of April 1 8, 1 995, Mr. Ken Landis, a representative for the Pearl Harbor Survivors Association Association) provided a brief presentation regarding the program this Association has been providing to the local high schools in Coachella Valley. The program consists of Pearl Harbor survivors talking to students about Pearl Harbor and World War II. The Association would like to further this program by making a documentary video film consisting of events leading up to Pearl Harbor, Pearl Harbor itself, and World War II. The film would be donated as a public relations educational aid to Coachella Valley high schools and made available to all high schools. The Pearl Harbor Survivors Association has determined a budget of $40,000 to complete the documentary. The Association is requesting the City's support and a donation towards the completion of the documentary. At the Council Meeting of April 1 8, 1 995, the City Council requested staff to determine the participation of the other cities in the Coachella Valley. The letter attached Attachment 1) was received from the Pearl Harbor Survivors Association in response to inquiries as to the status of participation by Coachella Valley Cities. RECOMMENDATION: Approve the Resolution Denying, Without Prejudice, the Cable Television Franchise Transfer Request. FISCAL IMPLICATIONS: The denial of the Transfer Request, in and of itself, will not cost the City any money. However, any future implications are unknown at this time. BACKGROUND AND OVERVIEW: Providence Journal is the current owner of the City's cable television franchise and Colony Cablevision is the franchise operator. On February 8,1995, Providence Journal notified the City of an impending franchise transfer of ownership Transfer Request") to Continental Cablevision. Since that time, the City has been in negotiations with Colony Cablevision regarding the Transfer Request, including contracting with a cable television consultant Municon) to assist the City in the Transfer Request. This process has proven to be a long, arduous process particularly when it comes to getting information from Colony Cablevision. Coincidentally, several other cities and the County of Riverside have experienced this same problem as they are also processing Transfer Requests for their respective entities from the same company. Further complicating the matter is the fact that the City is concurrently under negotiations for a new franchise agreement. The Transfer Request must be acted upon by June 5, 1995. Staff has recently utilized the services of Special Counsel Rutan & Tucker) to protect the City's legal interests in this matter. It is recommended that the Transfer Request be denied without prejudice while simultaneously requesting that Colony Cablevision agree to an extension of the Transfer Request to allow staff more time to concurrently solve the Transfer Request as well as the new franchise agreement issues. That Honey Atkins be appointed to the Riverside County Free Library Advisory Board to fill the unexpired term of Myra Bohnenberger term to expire June 30, 1997. FISCAL IMPLICATIONS: Costs related to this position will be funded from the City Council's Travel and Meetings Account. BACKGROUND AND OVERVIEW: On May 2, 1 995, the City Council accepted the resignation of Myra Bohnenberger from the Riverside County Free Library Advisory Board. Both The Friends of the La Quinta Library" and the local librarian, have recommended that Honey Atkins be appointed. Mrs. Atkins has been actively involved in The Friends" and as a volunteer at the library and was one of the founders of Round Table West.'1 This Board meets quarterly, generally in the western part of the County, although they try to schedule at least one meeting a year in either Coachella Valley or Blythe. The City would normally absorb the costs incurred by this individual, i.e. mileage reimbursement and lunch. Costs are estimated at $260 annually. FINDINGS AND ALTERNATIVES: 1. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORINA AMENDING SECTION 11.72.030(0) RELATING TO OUTDOOR BURNING THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: That Title 11, Chapter 11.72, Section 11.72.030(0) is hereby amended to read as follows: Outdoor burning of any material or structure unless sanctioned by the Fire Department as a training fire or when used as a cooking or comfort fire contained in a fire proof container no larger than four 4) feet in diameter. SECTION 2: EFFECTIVE DATE: This Ordinance shall be in full force and effect thirty 30) days after its adoption. SECTION 3: POSTING: The City Clerk shall within fifteen 15) days after passage of this Ordinance, cause it to be posted in at least three 3) public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting to be entered into the Book of Ordinances of the City of La Quinta. The proposed CSA-152 budget for Fiscal Year 1995/96 will fund the City's efforts to comply with the anticipated permit requirements under the National Pollutant Discharge Elimination System NPDES). The proposed budget allows the current assessment of $9?99 per Benefit Assessment Unit BAU) to be maintained in Fiscal Year 1995196. In 1987, Congress enacted Section 319 of the Clean Water Act, and established a national program to control non-point sources of water pollution. Non-point sources include any pollutants which may be picked up and carried by storm water and nuisance water runoff. The U.S. Environmental Protection Agency has charged individual states with controlling non-point pollution through the NPDFS. The City is required to apply to the California Regional Water Quality Control Board for an NPDES permit. The NPDES permit is expected to be issued to the City shortly. County Service Area 152 CSA-152) was formed specifically to provide a mechanism for local agencies in Riverside County to assess property owners for costs associated with complying with the requirements of the NPDFS. Conclusion After review of the current case law governing the regulation of adult orientated businesses, my recommendation is that La Quinta's Ordinance be updated to reflect the more detailed, specific criteria and less discretionary format required by both federal and state court interpretations as illustrated in Smith V. Los Angeles County Board of Supervisors 1994) Case No. B072488 and Dease V. City of Anahiem(C.D. Cal.1993) F.Supp. 336. II. Background and Current Status The City's current Adult Entertainment Ordinance located in Section 9.154 of the La Quinta Municipal Code was adopted in 1 992. At that time the regulation of adult entertainment businesses was primarily in the form of conditional use permit CUP") requirements. CUP's traditionally require findings of generic compatible use and allow great flexibility to the decision maker to fashion conditions for the individual business. By combining the traditional mode of regulating with the CUP and limiting the allowed uses to an overlay zone along Highway 111, with additional distance requirements from sensitive uses such as residential, schools, daycare providers, churches and other adult orientated businesses, La Quinta's ordinance has served the City well. However, the Smith case and the Dease case cited above, have called into question the constitutionality of utilizing a conditional use permit as the basic regulatory scheme thereby providing ample justification for reexamining the City's scheme for regulating this use. For example, in Dease, a saloon operator who wanted to feature wet T-shirt contests" and whipped cream wrestling contests" challenged Anahiem's ordinance which required a CUP as being facially unconstitutional. Cosper, Public Works Director/City Engineer Date: June 6, 1995 Re: Department Report Review of Conditions at the Intersection of Fred Waring Drive and Adams Street Introductioi': The City Council, at its May 16, 1995 meeting, requested information for the June 6,1995 Council meeting regarding the need for traffic control improvements at the intersection of Fred Waring Drive and Adams Street. The request was the result of a recent fatal accident and resulting public comment regarding the need for traffic signals at this intersection. At this date, the final police investigation has not been completed. Therefore, information directly related to the recent fatal accident cannot be made available for review by the City Council prior to the June 20,1995 Council meeting. Although the Public Works Department is still reviewing physical characteristics of this intersection, some information can be made available for review at this time. BakgrWnLd Traffic Signal Warrant Studies On October 4,1994, the Public Works Department concluded a traffic signal warrants study at this intersection and found that traffic counts were not sufficient to warrant traffic signals at that time. The October 4,1994 study was completed after the intersection of Ocotillo Drive and Fred Waring Drive was closed off, thus reflecting a more accurate traffic count of current conditions. To validate the study, additional traffic counts were initiated during the week of May 22-26,1995, and another warrant study was completed. Date: June 6,1995 Re: Department Report Assessment Formula on Large Non-Residential Vacant Lots in the Landscape and Lighting District 89-1 Backgr?mnd On February 7, 1995, the City Council reviewed recommendations contained in the Summary Report Landscape and Lighting District No.89-1 Analysis. A segment of the Report analyzed the vacant property annexations involving large area parcels greater than 1 acre). As the report indicates, the original Engineer's Report did not anticipate large parcels being annexed to the City. To address this, the Report recommended that the Vacant Non- Residential definition in the Engineer's Report be modified to the following: the first five 5) acres of a vacant Non-Residential parcel be assessed per the current formula; however, that portion of land greater than 5 acres per parcel be considered open space and exempt from assessment until such time parcelization or development occurs.,' The five 5) acre limit was chosen by the Consultant because development statewide typically occurs in increments of 5 acres or less. Prior to this modification, a 100 acre parcel would have been assessed $5,775. The maximum assessment for vacant land would drop to $288.75 under the modified definition. However, as the Report further points out, the total number of EDU's for the District would have dropped from the FY 1994/95 level of 24,484 to 19,942. This action alone would require the Citywide EDU rate to increase from $35/EDU to approximately $52/EDU. During the February 7, 1995 City Council meeting, staff presented a graph that outlined the impacts to the Citywide EDU rate based upon the acreage limit in the modified definition Attachment 1). The City Council directed staff to maintain the EDU rate for FY 1995/96 at the $43/EDU level. To do so required the maximum assessed acreage be increased from 5 acres to 20 acres. Based upon a 20 acre maximum and an EDU rate of $43/EDU, the maximum assessment for vacant land would increase from $288.75 to $1,419. Applicant: Travertine Corporation RECOMMENDATION: 1 Adopt City Council Resolution certifying the Final EIR as adequate and complete, recognizing over-riding considerations to certain adverse impacts and recognizing significant, but mitigatible environmental effects due to project implementation. 2. Adopt Council Minute Order supporting the approval of this section of the composite General Plan Resolution noted as Item 4. 3. Adopt City Council Resolution approving Specific Plan 94-026, subject to the attached Conditions of Approval. FISCAL IMPLICATIONS None BACKGROUND AND OVERVIEW: This application is continued from the May 2, 1995, Council meeting. There were three outstanding issues that the applicant was given time to attempt to resolve for this project. These issues are school impact, Big Horn Sheep, and trails. Meetings were held with the California Department of Fish and Game and the Coachella Valley Unified School District. Attachment 1 outlines the concerns, discussions that transpired, and any resolution that was agreed upon. FINDINGS AND ALTERNATIVES: The findings are contained in the resolutions. The options available to the Council are as follows: 1. Approve the project as recommended by the Planning Connnission. 2. Approve the project with Council changes. 3. Deny the project. 4. FISCAL IMPLICATIONS: The Jefferson Street Alignment Study is funded with developer funds; it has no impact to the City Budget. BACKGROUND AND OVERVIEW: The existing right-of-way for Jefferson Street between Avenue 58 and Avenue 62 is mostly unimproved and crosses extremely rugged terrain. This segment of right of way was acquired by the County in 1 901 when the County Board of Supervisors adopted an ordinance that established a 60-foot wide right of way on section lines in selected areas of Riverside County. The only portion of this segment that is currently improved occurs at the northerly end, near Avenue 58, where the street passes around the south end of Lake Cahuilla and terminates in the county park. During the development entitlement process for The Quarry golf club project, land owners in the vicinity of this unimproved segment of Jefferson Street raised questions regarding the future improvement of Jefferson Street. FISCAL IMPLICATIONS: None BACKGROUND AND OVERVIEW: General This application is to allow a new sales center and model complex on the west side of PGA Boulevard just south of the Tennis Complex. The application also allows eight new production units which are a part of the model complex for use within PGA West. Project Proposal The sales center and model complex will consist of a total of nine units of which one will be utilized for the sales center. From this model complex, units built throughout PGA West will be sold. Access to this area will be through a new driveway to PGA Boulevard. The new production units proposed for construction within PGA West vary in size from 2,065 square feet to 4,542 square feet. The one story units are SpanishiMediterranean in architectural style and materials. The units comply with the Compatibility Ordinance 242 which pertains to partially constructed projects. The sizes fall within the range allowed in PGA West and the Planning Commission determined as part of their approval that the units are architecturally compatible with the existing units within the project. A detailed description of the model complex and new production units can be found in the attached Planning Commission staff report Attachment 1). Plannin? rolls RECOMMEND?ON: Move to adopt City Council Resolution approving the requested rate increase for waste collection services, landfill disposal, landfill closure, and AB939 compliance; and direct charges for residential properties to be added to the tax rolls. FISCAL IMPuC?ONS: The proposed assessment includes the Waste Management of the Desert requested rate increase of 75% for waste collection services, the current $38.50 per ton pass-through for County landfill disposal and landfill closure costs, and an increase of 05 cents per household from 29 cents per month to 34 cents per month for the AB939 Compliance Fee. The 1995-96 assessment on residential properties for waste collection services, landfill disposal, landfill closures, and AB 939 compliance are proposed as follows: Residential collection $ 6.70 per month Landfill disposal 2.50 per month Landfill closure 18 per month AB939 compliance 34 per month Total monthly charge $ 9.72 Total annual assessment $116.64 The City will generate approximately $110,000 in annual revenue for AB939 compliance activities in Fiscal Year 1995-96. The City will expend approximately $82,000 in salary, benefits and overhead; and approximately $60,000 for local program implementation; for a total of $142,000 or a shortfall of $32,000. This shortfall will come from general funds.
