This project will be constructed concurrently with a separately bid street improvement project that will widen and improve this intersection and add additional travel lanes. Due to the length of time necessary for signal contractors to secure materials 12 to 16 weeks), we expect the intersection widening project to be completed well before the traffic signal is operational. The signal project's construction cost is estimated to be $85,000 and sufficient funds are available for this budgeted project in account number 002-4813-145-000. This project will be constructed concurrently with another City project that will install a traffic signal at this intersection. The separate bidding of these projects were structured this way in order to secure the most cost effective bids for the City. The future second Washington Street road improvement project will be for that area between just north of 50th Avenue to the church property. Due to the long lead time for securing materials for signal projects this intersection improvement project should be completed well before the signal contractor installs the poles and controller. The bid documents will also advise both contractors of the requirement to coordinate their activities. As a part of this project the oleander hedge row on Washington Street north of 50th Avenue will be trimmed back for visibility for the new interim stop sign as well as future visibility to the signal heads for the future traffic signal. This project, as currently programmed will not construct any sound walls along the west Washington Street right of way as had been requested by some local citizens. Additionally, this project will fill-in" a majority of the dirt slot that separated the old Washington Street pavement from the travel lanes currently in use. As a vertical grade differential of some 10-inches maximum exists between the two pavement sections, a simple pave" to fit approach does not work. Portions of the existing south bound travel way will be reconstructed to a proper cross fall to join the old pavement section. We are in the process now of accumulating bids for the electrical power, water, gas, telephone, sewage, grading, etc., and we estimate the costs to be in excess of $80,000. The Elvirita Lewis Foundation is in no position sustain these kinds of costs, however, we are working hard on fundraising development. We are finding that very few wealthy people are even Interested in listening to us once they hear that we have only a three year lease with the city for the property. They justifiably expect that the center would be able to continue operations for many years before they want to put money into it. We ask you this: If the Elvirita Lewis Foundation would agree to raise funds to improve the site at the Avenue 50 Park for the purpose of building and operating an intergenerational child care center--which would care for La Quinta children and employ La Quinta senior citizens--would the city agree to extend the one dollar a year lease to ten years with two ten year extensions? We feel that this would be fair in that we will need to put considerable capital into the site improvements, and our fundraising development depends upon a stable foreseeable future for the center. Also, since we are generally improving city property without cost to the city, we believe that building permit fees should be waived. John Walling is finishing the plans which we will submit for approval within two weeks. I understand from Mark and Steve that you most generously offered to help us as much as you could with the high costs of developing this site when we returned the $20,000 CDBG grant. We wish to be fair and to be able to serve the children, working parents and senior citizens of La Quinta and we are happy that the City of La Quinta is helping us to do so. As we discussed, the area has been redefined, from the initial study area of 1,500+ acres, to a new total area of 443.93+ acres.. Preliminary data prepared for this area is summarized as follows: EXHIBIT A delineates the study area boundaries and summary data; EXHIBIT B shows subdivided and other physically developed properties within the study area, as defined in Section 33320.1 of the California Government Code. The subdivided vacant lots within Indian Springs may be considered as developed for the purpose of this study. EXHIBIT C shows properties which could be characterized by faulty lot layout and/or subdivision design under Section 33320.1. It should be noted that this also qualified an area as blighted un*er Section 33032. EXHIBIT D shows property which could be considered an integral part of an area or areas developed for urban use. These areas are based on the Government Code criteria for developed properties in order to ensure consistency, and also includes the flood control channel because the right-of-way is existing. This is essentially similar to considering the vacant lots in Indian Springs as developed, since they are committed to single-family home development, while the channel is zoned W-1 and committed to flood control. These designations are subject to interpretation as to whether they can be considered integral'1 from a definitive standpoint.) I should point out here that some of the evaluation of property is inherently subjective, and it may be that some deletions or additions could be accommodated as the study continues. At this time, the initial area is a best shot" based upon the objectives of your office and overview of redevelopment law. A final footnote to consider is the relationship of the criteria under Section 33320.1. In order for the project area to be considered predominantly urbanized" it must meet one of three criteria. One of these criteria is that 80 percent of the privately-held land in the project area must be developed. A consideration that needs to be looked at from a legal standpoint is how this criterion is applied in conjunction with the two other factors which determine predominantly urbanized land for a project area. This initial study assumes that all three criteria can be used independently in establishing a project area; therefore, the 80 percent requirement is not as crucial as it would be if that were the only limiting factor in qualifying an area as predominantly urbanized". Otherwise, based on the study boundary, approximately 288 acres would have to be privately held, developed land; within the current study area there are only 152.1 such acres.
