SUBJECT: RESIDENTIAL AND COMMERCIAL DEVELOPMENT PLOT PLANS
BACKGROUND
The lack of participation by the Planning Commission in the
review of commercial and multi-family residential projects was
identified ied as a concern by the Commission. An immediate
response to this concern was the adoption of an urgency
ordinance granting the Commission review authority. An urgency
ordinance allows an interim solution to be provided for an
identified problem while the concern is analyzed more fully and
a permanent means to address the problem/concern is initiated.
In this case, the issue was the reviewing entity for commercial
and multi-family residential projects. The zoning ordinance
provided for an administrative plot plan approval process,
which did not come before the Commission or City Council
In January 1986, the Planning Commission recommended to the
City Council that an urgency ordinance be adopted, reassigning
review authority to the Commission for all proposed commercial
projects, including additions and exterior remodels. The City
Council concurred with this recommendation and adopted Urgency
Ordinance No* 90. This Ordinance subsequently has been
extended to the maximum time permitted by State Government Code.
Likewise, for multi-family residential projects, the
Commission, in November 1987, requested review authority. The
Council again concurred with the Commission's request and
adopted an urgency ordinance granting review authority for
projects containing 25 or more units.

The Planning Commission considered the proposed ordinance
revisions at a Public Hearing conducted on January 26, 1988.
The Commission recommended adoption of the attached ordinance,
and the accompanying environmental determination.
ENVIRONMENTAL CONSIDERATION
The Planning Commission recommended adoption of a Negative
Declaration prepared for the zoning text amendment based upon
an environmental assessment prepared as required by the
California Environmental Quality Act CEQA). The initial study
evaluation determined that the proposed ordinance will not, by
itself, present a significant adverse impact. Future review of
proposed individual projects will be subject to CEQA review.
PROPOSED ORDINANCE
The attached Ordinance replaces the two urgency ordinances with
permanent Commission review authority for certain commercial
and multi-family residential projects. The review will either
take place as a business item non-public hearing) or as a
public hearing item, depending upon the type of application.
The Commission action is then transmitted to the Council as an
information item for consideration on the Consent Calendar.
Other aspects of the individual zoning districts were not
addressed i.e., the permitted uses listed within each zoning
chapter). These matters will be reviewed during the
preparation/review of the new Zoning Ordinance.

Subject: Implementation Committee for Village at La Quinta
Specific Plan
The composition of an implementation committee for the Village
at La Quinta depends largely on what the Council intends for
the committee to accomplish. Some of the Committee's potential
tasks could be:
1. To give advice to the Council on the feasibility of
various aspects of the project.
2. Recommend a development strategy that would increase
the chances of the plan being realized and the
economic success of the overall plan and its
individual elements) when it is realized.
3. To recommend a specific plan of action to the City on
how to proceed with implementation and how to
encourage private developers and property owners to
participate in the realization of the plan.
4. Develop a feasible time line for the City to implement
the plan, with goals and benchmarks.
5. To be the visible entity within the general community
to promote the advancement of the Village Plan.
6. To create a group of missionaries" that would
encourage developers and businesses outside the City
to buy into the Village Plan. Perhaps some of them
are already involved or would become involved in
development of the Village.
Some individuals in the valley are extremely experienced in
planned retail development of the kind we envision. They may
or may not already have an interest in La Quinta, but they are
probably aware, at least, of the Village Specific Plan and that
something will soon be happening in the downtown area of La
Quinta.

Many of these are too busy to be extensively involved in the
day to day work of helping the City implement its plan, but
they may be willing to serve on a blue-ribbon" advisory panel
something like the Charrette process). By learning more about
the village at La Quinta and getting a feel for the City's
plans, they may be inspired to become more economically
involved in a specific part of the project.
Some names that may be considered for such an advisory group
are John Wessman, Ron Birtcher/Curt Dunham, Bill Burnett and
Bill Carver.
Others who may have a more direct interest or local expertise
are Rick Johnson, Bob Monroe, Tom Kennedy, Gary Lohman, John
Walling, Lauren Lewis, Ed Nicholson, John Bund, Judy Vossler,
Charles White, Skip Fonner and Susan Fox.
Of course the City Council and City Staff should also be
involved as the action arm" of an implementation committee.
These are all people with the expertise and the power to make
it happen". These suggestions are certainly not all inclusive,
and there may be important others who need to be involved for
various reasons. Of course there will also be a need for the
services of specialized outside consultants on specific aspects
of the plan.

The issue has been raised concerning the propriety of
Valley Plumbing parking its step-van delivery truck at private
residences overnight. The company has indicated that this truck
is used for responding to 1temergencyt' calls after usual business
hours.
City Code Section 12.32.110 prohibits parking certain
commercial vehicles on private property or in public rights-of-
way unless the vehicle is screened from public view and from the
a*jacent properties. That code section defines a commercial
vehicle as including, but not necessarily limited to, a number of
varying kinds of vehicles including step-van delivery trucks".
It is my understanding that the particular vehicle does quality
as a step-van delivery truck.
EXCEPTIONS i* THE FOREGOING

prohibition against parking.

ENHANCEMENT PROGRAM" AND COUNCIL OPTION TO CONTINUE OR
REPROGRAM FUNDS FOR SENIOR CENTER SITE IMPROVEMENTS
BACKGROUND
At your direction on March 17, 1987, the Staff has pursued the
implementation of the Home Enhancement Program using carried over
funds to negotiate and execute a contract with the Riverside County
Housing Authority to accomplish the program as an adjunct to their
other ongoing Home Improvement Program activities. The program will
target low and moderate income as well as senior and handicapped
persons, however, La Quinta's specified Entitlement Funds will be
used to expand the County's HIP program for La Quinta residents.
Home improvement opportunities will include such activities as:
*Physical Structure Improvements:
Exterior patching, painting or roofing, yard improvements such
as fencing and driveway repairing, and minor landscaping
improvements.
*Interior Repairs:
To include improvements to improve safety and reduce health
hazards such as water heater repairs, air conditioning repairs,
interior floor, wall repairs, and weatherization including
replacement of broken windows and doors.
Improvements and/or grants will be awarded only to eligible
applicants. As with the previously designed program, limits of $1000
to low income and $750 for moderate income households in the form of
grants or improvements will be made by the Housing Authority.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, ENDORSING
A TASK FORCE COMMITTEE TO ADDRESS AREA
TRANSPORTATION REQUIREMENTS.
WHEREAS, the Cities of Coachella, Indio, La Quinta and
County of Riverside share common concerns with relation to area
U) transportation requirements, i.e., street design, improvements,
ID landscaping and ongoing maintenance; and
Cr) WHEREAS, these are issues that affect the general
* public, and
co WHEREAS, work has been done over the past year of
identifying common concerns and an approach to solutions and
continued communication and cooperation is desirable for
continued progress toward joint studies and solutions.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA
QUINTA HEREBY RESOLVES AS FOLLOWS:
I
That the City of La Quinta is committed to forming the
EAST COACHELLA VALLEY TRANSPORTATION COMMITTEE.
II
That the City Manager is directed to represent and/or
have representatives from City Staff to meet with the
participating jurisdictions on at least a quarterly basis to
work jointly to:
* identify priorities
* promote continuing communication on joint issues
* promote cooperative relationships on joint issues
* promote joint identification of solutions
* promote joint funding of projects when appropriate

The City Council of La Quinta hereby commits staff
time and staff work to meet on a regular schedule and to provide
staff support for preparation of required materials and reports

Please note that this new contract Indicates a rental
increase of $5.00 per month bringing your month]y rental
payment to $110.00.
I would like to take this opportunity to explain the two 2)
methods of payment we offer.
1. Monthly rental payment of $110.00 which totals
$1320.00 for one year.
2. A years advance payment of $1254.00 which reflects a
discount of $66.00 for prepayment.
Pent is billed monthly, in advance, and Is due on the first
of the month following the statement date. The account
becomes delinquent on the tenth of the month following the
statement date. All accounts thirty-days past due are
considered for shut-off.
We have also included in this new contract a clause allowing
us to charge a service charge for late payments. Selecting
to pay the yearly amount would avoid any service charges or
interruption in service due to overlooked payments.

SPECIAL ADVERTISING* DEVICES
BACKGROUND
Municipal Code Chapter 5.64, Special Advertising Devices",
provides for a permit to be issued by the City Council for
advertising devices other than the usual and customary
permanent business identification signs; and, includes signage
for special events/occasions.
REQUEST
The referenced request has been received from the La Quinta
Arts Foundation in application for one 10-1/2' x 21' portable
port-a-panel) sign to be located at the southeast corner of
Washington Street and Highway 111, two 3' x 15' cloth banners
suspended from palm trees at the eastern and western ends of
the park, and a number of informational/directional signs along
major streets. The Foundation would like to install the
portable sign on February 19, 1988, and the others on March 1,
1988. The specifics of this request are contained in the
attached correspondence, dated January 12, 1988. All signs
will be removed on March 8, 1988.
DISCUSSION
1. The proposed signs will be located within City
right-of-way and on private property.
2. The Public Works Department has reviewed the sign
locations and noted that: a) construction on the
traffic signal at the intersection of Avenue 50 and
Washington Street will be underway during the festival,
and b) the signs should be located so as not to create a
traffic hazard.

On behalf of Landmark Land Company, the City Council of the
City of La Quinta, by Minute Order Action on February 2, 1988,
respectfully requests your assistance in introducing a bill to
facilitate their purchase of land within the City of La Quinta
which is presently under the jurisdiction of the Bureau of Land
Management.
The property in question is almost entirely hillside land
in the Santa Rosa mountains. As you are aware, Landmark owns
all adjacent property and is construction outstanding
facilities. The subject property will be landlocked if
purchased by anyone other than Landmark.
Landmark Land Company is willing to purchase this property
at federally appraised fair market value. The proceeds of the
sale by BLM will further the establishment of the Coachella
valley Fringe Toed Lizard Reserve.
Your assistance in this matter will be greatly appreciated.

Subject: MEALS ON WHEELS PROGRAM IN LA QUINTA
BACKGROUND
Currently there is not a Meals on Wheels program serving
La Quinta.
Meals on Wheels is designed for individual* who have
suffered a physical/medical problem which prevents them
from adequately preparing their own meals. Meals are
then delivered to them for a price from $2.50 $3.50
which contains two meals- breakfast-cold and a lunch hot.
Because neighboring programs at the Joslyn Cove Communities
Senior Center and the RSVP Program in Indio will not come into
La Quinta, alternatives have been investigated.
In October the problem was addressed to the Community Services
Commission with the Commission adopting a motion supporting
a Meals on Wheels program in La Quinta and asking that the
City Council consider a program in next year's budget.
1. In addition, the Commission requested that a letter to Desert Area
Meals on Wheels asking for funding to establish a Meals on Wheels
program in La Quinta be sent.
2. Asking the Board of Directors of the Desert Area Meals on Wheels
to have the Joslyn Cove Communities program or the Indio program
provide meals to residents in La Quinta.
3. Requesting the City Council to allow for applications to apply
for grant money for a program in La Quinta.
Meeting have been held with the Desert Area Meals on Wheels Board
of Directors and they have agreed to fund $200.00 to the La Quinta
Meals on Wheels satelite program to buy equipment needed to open
a program. They have also agreed to ask for additional funding
to help pay for a coordinator for La Quinta's program for two hours
a day for five days a week. This funding may not be available for
six months unless new funding sources can be located sooner.)

Dear Mayor Hoyle:
On March 1, 1988 customers of Palmer Cablevision, a division of
Palmer Communications Incorporated, will be charged $13.85 per
montb for basic cable television service. In notifying the City of
La Quinta of this new rate, Palmer CableVision would like to review
in brief why a rate increase will be implemented.
As we have discussed in previous meetings with city officials,
during the past three years all cable companies, including Palmer,
have seen substantial increases in operating costs. The most
significant increases have come in the areas of payments to
programming services such as ESPN, CNN and MTV, which constitute
our basic service package and which are some of the most popular
channels with your constituent. In our company alone, payments to
programmers have increased twelve-fold in the past three years and
some suppliers of basic cable programming doubled their rates in
1987 alone.
Our industry, like others, also has seen dramatic increases in
other operation costs. Insurance coverage is one area where the
cable business has been' hit especially hard. As one example, the
State of California tripled the rate for worker' 5 compensation
coverage fo'r cable companies in 1987.
The need for an increase in rates is readily apparent. Many cable
companies here in Riverside County and around the nation have
responded to this need by imposing huge increases in their rates
for basic service. We at Palmer Cablevision believe that we have
taken a more tempered approach to rate increases. Our new basic
cable television rate of $13.85 for 1988 remains the lowest charge
of any major operator in Riverside County and our rates are
substantially lower tban any major cable company throughout the
Coachella Valley.

While Palmer's rate increases in the past several years have been
moderate, the commitment of Palmer Cablevision to expanded and
improved service has remained strong. In 1987. Palmer invested
$2.5 million in new plant and equipment to keep up with the
explosive growth in the Coachella Valley. Palmer Cablevision has
responded to the need for greater customer service by, in 1987
alone, adding 15 employees specifically devoted to customer service
and direct contact with the public. Palmer Cablevision remains
committed to our franchising governments. In 1987, Palmer
Cablevision will have paid more than $500,000 in franchise fee
payments in support of Riverside County and city governments. As
well, Palmer CableVision remains one of the largest employers in
the region. with its work force of 140.
While none of those 140 employees wish to see their neighbors pay
higher rates, each Palmer employee remains dedicated to the goal of
providing their neighbors with the best quality service at the most
economical rate possible. At a basic rate of $13.85 for 1988 we
think we can reach that goal.

ON JANUARY 25, 1988, THE COMMUNITY SERVICES COMMISSION DISCUSSED
THE GRANT AWARDS PROGRAM AND MADE THE FOLLOWING RECOMMENDATIONS:
1. Require that only projects with a demonstrable impact on La
Quinta be funded.
2. Lower the dollar amount to approximately $25,000 and
encourage organizations to limit their request to 25% of
their budget to encourage organizations to seek other
funding alternatives.
3. Remove the La Quinta Chamber of Commerce and La Quinta Arts
Foundation from the process and provide a 1Contract-for
Service" to those or similar organizations that provide a
service product to the City on a continuing basis. The
Community Services Commission asked that they be involved in
negotiating said contracts.

the application as attached.

The Planning and Development Department has been compiling in
the past year a series of public information sheets, as a guide
to construction and planning permit procedures. As we continue
to develop more aids for the general public, prospective
developers and persons involved in construction, we thought it
might be timely to bring the Council up to date on the
materials that are now available.
For your reference and library, copies of two handout
compendiums planning and building) will be distributed at the
February 1 Study Session. The Department welcomes any
suggestions the Council may have for these documents, or
identification of other subjects which may be of benefit to the
homeowner/resident and builder, which could be addressed in
this format.

BACKGROUND
THE CITY CURRENTLY HAS NO POLICY WITH REGARD TO RETENTION OF
TAPES OF COUNCIL MEETINGS. THE CITY IS CURRENTLY RETAINING ALL
TAPES FROM DATE OF INCORPORATION. SINCE TAPING IS DONE
EXPRESSLY FOR THE PURPOSE OF AIDING IN THE PREPARATION OF THE
WRITTEN MINUTES, I BELIEVE A POLICY SHOULD BE ADOPTED.
A RECENT SURVEY OF ALL COACHELLA VALLEY CITIES REVEALED THE
FOLLOWING POLICY a:
CATHEDRAL CITY RETAINS ALL
COACHELLA 6 MONTHS
DESERT HOT SPRINGS 6 MONTHS
INDIO UNTIL WRITTEN MINUTES ARE APPROVED
PALM DESERT 1 YEAR
PALM SPRINGS 2 YEARS
RANCHO MIRAGE UNTIL WRITTEN MINUTES ARE APPROVED
THERE APPEARS TO BE NO UNIFORM POLICY IN THIS REGARD.
I WOULD RECOMMEND THAT WHATEVER POLICY IS ADOPTED, THAT IT ALSO
APPLY TO ALL BOARDS AND COMMISSIONS OF THE CITY.
RECOMMENDATION
1. ESTABLISH A POLICY TO BE INCORPORATED IN CITY COUNCIL
RESOLUTION NO. 87-hA
2. STAFF'S RECOMMENDATION IS THAT THE TAPES BE RETAINED ONLY
UNTIL THE WRITTEN MINUTES ARE APPROVED.
3. IF THIS IS NOT THE CITY COUNCIL'S PLEASURE AT THIS TIME, I
WOULD RECOMMEND THAT THEY BE RETAINED FOR NO LONGER THAN ONE
YEAR.

SUBJECT: Commercial Vehicle Inspection Program

The technical committee for the Cove Communities Public Safety
Commission met on January 20, 1988, and did not have any objections
to the City of La Quinta joining with the Cove Commission in the
vehicle inspection program. The committee will pass on their
opinions to the commission.
The Cove Commission will have to meet to consider our request, and
if it is agreeable with the commission, the particulars would have
to be worked out such as:
1. The cost of sharing or buying in on the scales
2. The amount of time the scales would be allotted to the
City
The cost of Sheriff's time would come out of the City's traffic
enforcement time.
I will keep you advised as to the outcome of the Cove Commission's
action.

I had a meeting with Mrs. Graham on January 27, 1988, which was very
productive.
The yard has been cleaned up, trees have been trimmed, and trash has
been picked up. The rustic decor is still in place, but looks much
better than when our action was started. The volkswagon has also
been removed.
I have photographs of the property showing the condition before and
after. The shelves on the Avenida Monterey side will be covered, and
thus will eliminate that problem.
If there are any more problems, I will keep you informed.

OLD BUSINESS:
Item No. 1.
Mr Reynolds reported on the action taken by the City Council at its
meetinq, January 5th. The Council voted to not allow the
installation of a 3-way stop, but after hearing presentations made by
persons in the audience, the Council tentatively agreed to share in
the cost of a traffic signal. They also instructed the staff to
install lane delineator along the cross-hatched zone and to install
flashing beacons.
