An immediate response to this concern was the adoption of an urgency ordinance granting the Commission review authority. An urgency ordinance allows an interim solution to be provided for an identified problem while the concern is analyzed more fully and a permanent means to address the problem/concern is initiated. In this case, the issue was the reviewing entity for commercial and multi-family residential projects. The zoning ordinance provided for an administrative plot plan approval process, which did not come before the Commission or City Council In January 1986, the Planning Commission recommended to the City Council that an urgency ordinance be adopted, reassigning review authority to the Commission for all proposed commercial projects, including additions and exterior remodels. The City Council concurred with this recommendation and adopted Urgency Ordinance No* 90. This Ordinance subsequently has been extended to the maximum time permitted by State Government Code. Likewise, for multi-family residential projects, the Commission, in November 1987, requested review authority. The Council again concurred with the Commission's request and adopted an urgency ordinance granting review authority for projects containing 25 or more units. The Commission recommended adoption of the attached ordinance, and the accompanying environmental determination. ENVIRONMENTAL CONSIDERATION The Planning Commission recommended adoption of a Negative Declaration prepared for the zoning text amendment based upon an environmental assessment prepared as required by the California Environmental Quality Act CEQA). The initial study evaluation determined that the proposed ordinance will not, by itself, present a significant adverse impact. Future review of proposed individual projects will be subject to CEQA review. PROPOSED ORDINANCE The attached Ordinance replaces the two urgency ordinances with permanent Commission review authority for certain commercial and multi-family residential projects. The review will either take place as a business item non-public hearing) or as a public hearing item, depending upon the type of application. The Commission action is then transmitted to the Council as an information item for consideration on the Consent Calendar. Other aspects of the individual zoning districts were not addressed i.e., the permitted uses listed within each zoning chapter). These matters will be reviewed during the preparation/review of the new Zoning Ordinance. Some of the Committee's potential tasks could be: 1. To give advice to the Council on the feasibility of various aspects of the project. 2. Recommend a development strategy that would increase the chances of the plan being realized and the economic success of the overall plan and its individual elements) when it is realized. 3. To recommend a specific plan of action to the City on how to proceed with implementation and how to encourage private developers and property owners to participate in the realization of the plan. 4. Develop a feasible time line for the City to implement the plan, with goals and benchmarks. 5. To be the visible entity within the general community to promote the advancement of the Village Plan. 6. To create a group of missionaries" that would encourage developers and businesses outside the City to buy into the Village Plan. Perhaps some of them are already involved or would become involved in development of the Village. Some individuals in the valley are extremely experienced in planned retail development of the kind we envision. They may or may not already have an interest in La Quinta, but they are probably aware, at least, of the Village Specific Plan and that something will soon be happening in the downtown area of La Quinta. By learning more about the village at La Quinta and getting a feel for the City's plans, they may be inspired to become more economically involved in a specific part of the project. Some names that may be considered for such an advisory group are John Wessman, Ron Birtcher/Curt Dunham, Bill Burnett and Bill Carver. Others who may have a more direct interest or local expertise are Rick Johnson, Bob Monroe, Tom Kennedy, Gary Lohman, John Walling, Lauren Lewis, Ed Nicholson, John Bund, Judy Vossler, Charles White, Skip Fonner and Susan Fox. Of course the City Council and City Staff should also be involved as the action arm" of an implementation committee. These are all people with the expertise and the power to make it happen". These suggestions are certainly not all inclusive, and there may be important others who need to be involved for various reasons. Of course there will also be a need for the services of specialized outside consultants on specific aspects of the plan. The company has indicated that this truck is used for responding to 1temergencyt' calls after usual business hours. City Code Section 12.32.110 prohibits parking certain commercial vehicles on private property or in public rights-of- way unless the vehicle is screened from public view and from the a*jacent properties. That code section defines a commercial vehicle as including, but not necessarily limited to, a number of varying kinds of vehicles including step-van delivery trucks". It is my understanding that the particular vehicle does quality as a step-van delivery truck. The program will target low and moderate income as well as senior and handicapped persons, however, La Quinta's specified Entitlement Funds will be used to expand the County's HIP program for La Quinta residents. Home improvement opportunities will include such activities as: *Physical Structure Improvements: Exterior patching, painting or roofing, yard improvements such as fencing and driveway repairing, and minor landscaping improvements. *Interior Repairs: To include improvements to improve safety and reduce health hazards such as water heater repairs, air conditioning repairs, interior floor, wall repairs, and weatherization including replacement of broken windows and doors. Improvements and/or grants will be awarded only to eligible applicants. Meals on Wheels is designed for individual* who have suffered a physical/medical problem which prevents them from adequately preparing their own meals. Meals are then delivered to them for a price from $2.50 $3.50 which contains two meals- breakfast-cold and a lunch hot. Because neighboring programs at the Joslyn Cove Communities Senior Center and the RSVP Program in Indio will not come into La Quinta, alternatives have been investigated. In October the problem was addressed to the Community Services Commission with the Commission adopting a motion supporting a Meals on Wheels program in La Quinta and asking that the City Council consider a program in next year's budget. 1. In addition, the Commission requested that a letter to Desert Area Meals on Wheels asking for funding to establish a Meals on Wheels program in La Quinta be sent. 2. Asking the Board of Directors of the Desert Area Meals on Wheels to have the Joslyn Cove Communities program or the Indio program provide meals to residents in La Quinta. 3. Requesting the City Council to allow for applications to apply for grant money for a program in La Quinta. Meeting have been held with the Desert Area Meals on Wheels Board of Directors and they have agreed to fund $200.00 to the La Quinta Meals on Wheels satelite program to buy equipment needed to open a program. They have also agreed to ask for additional funding to help pay for a coordinator for La Quinta's program for two hours a day for five days a week. This funding may not be available for six months unless new funding sources can be located sooner.) In notifying the City of La Quinta of this new rate, Palmer CableVision would like to review in brief why a rate increase will be implemented. As we have discussed in previous meetings with city officials, during the past three years all cable companies, including Palmer, have seen substantial increases in operating costs. The most significant increases have come in the areas of payments to programming services such as ESPN, CNN and MTV, which constitute our basic service package and which are some of the most popular channels with your constituent. In our company alone, payments to programmers have increased twelve-fold in the past three years and some suppliers of basic cable programming doubled their rates in 1987 alone. Our industry, like others, also has seen dramatic increases in other operation costs. Insurance coverage is one area where the cable business has been' hit especially hard. As one example, the State of California tripled the rate for worker' 5 compensation coverage fo'r cable companies in 1987. The need for an increase in rates is readily apparent. Many cable companies here in Riverside County and around the nation have responded to this need by imposing huge increases in their rates for basic service. We at Palmer Cablevision believe that we have taken a more tempered approach to rate increases. In 1987. Palmer invested $2.5 million in new plant and equipment to keep up with the explosive growth in the Coachella Valley. Palmer Cablevision has responded to the need for greater customer service by, in 1987 alone, adding 15 employees specifically devoted to customer service and direct contact with the public. Palmer Cablevision remains committed to our franchising governments. In 1987, Palmer Cablevision will have paid more than $500,000 in franchise fee payments in support of Riverside County and city governments. As well, Palmer CableVision remains one of the largest employers in the region. with its work force of 140. While none of those 140 employees wish to see their neighbors pay higher rates, each Palmer employee remains dedicated to the goal of providing their neighbors with the best quality service at the most economical rate possible. THE CITY IS CURRENTLY RETAINING ALL TAPES FROM DATE OF INCORPORATION. SINCE TAPING IS DONE EXPRESSLY FOR THE PURPOSE OF AIDING IN THE PREPARATION OF THE WRITTEN MINUTES, I BELIEVE A POLICY SHOULD BE ADOPTED. A RECENT SURVEY OF ALL COACHELLA VALLEY CITIES REVEALED THE FOLLOWING POLICY a: CATHEDRAL CITY RETAINS ALL COACHELLA 6 MONTHS DESERT HOT SPRINGS 6 MONTHS INDIO UNTIL WRITTEN MINUTES ARE APPROVED PALM DESERT 1 YEAR PALM SPRINGS 2 YEARS RANCHO MIRAGE UNTIL WRITTEN MINUTES ARE APPROVED THERE APPEARS TO BE NO UNIFORM POLICY IN THIS REGARD. I WOULD RECOMMEND THAT WHATEVER POLICY IS ADOPTED, THAT IT ALSO APPLY TO ALL BOARDS AND COMMISSIONS OF THE CITY. RECOMMENDATION 1. ESTABLISH A POLICY TO BE INCORPORATED IN CITY COUNCIL RESOLUTION NO. 87-hA 2. STAFF'S RECOMMENDATION IS THAT THE TAPES BE RETAINED ONLY UNTIL THE WRITTEN MINUTES ARE APPROVED. 3. The committee will pass on their opinions to the commission. The Cove Commission will have to meet to consider our request, and if it is agreeable with the commission, the particulars would have to be worked out such as: 1. The cost of sharing or buying in on the scales 2. The amount of time the scales would be allotted to the City The cost of Sheriff's time would come out of the City's traffic enforcement time. I will keep you advised as to the outcome of the Cove Commission's action. The yard has been cleaned up, trees have been trimmed, and trash has been picked up. The rustic decor is still in place, but looks much better than when our action was started. The volkswagon has also been removed. I have photographs of the property showing the condition before and after. The shelves on the Avenida Monterey side will be covered, and thus will eliminate that problem. Mr Reynolds reported on the action taken by the City Council at its meetinq, January 5th. The Council voted to not allow the installation of a 3-way stop, but after hearing presentations made by persons in the audience, the Council tentatively agreed to share in the cost of a traffic signal.
