I RESOLUTION NO.* A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, ACCEPTING THE DEED TO THE DESERT CLUB PROPERTY FROM THE FRITZ BURNS FOUNDATION. WHEREAS, the La Quinta Desert Club which is owned by the Fritz Burns Foundation has been an historical and significant part of the community since the 1930's; and WHEREAS, the Fritz Burns Foundation, which are substantial land holders in La Quinta believe that they should make contributions to the communities in which they do business in; and WHEREAS, the Fritz Burns Foundation, of which William Hannon is the Chairman of the Board has determined that it is in the best interest of the Desert Club property to become a permanent part of the City of La Quinta; and WHEREAS, the Fritz Burns Foundation, on December 29, 1988, presented the deed to the Desert Club property to the City of La Quinta with the stipulation that a majority of the property be retained for park purposes and that the Fritz Burns Foundation be memorialized for said contribution. NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of La Quinta, California, that the deed to the La Quinta Desert Club Property be accepted from the Fritz Burns Foundation and FURTHER, that the City Council agrees to retain a majority of the property as a park to be named the 11Fritz B. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA DECLARING THE INTENT OF THE CITY OF LA QUINTA TO ORDER THE CONSTRUCTION OF CERTAIN IMPROVEMENTS AND TO FORM ASSESSMENT DISTRICT NO. 88-1 AND MAKING CERTAIN FINDINGS AND DETERMINATIONS IN CONNECTION THEREWITH WHEREAS, this City Council wishes to consider ordering the construction of certain improvements and the formation of an assessment district to pay the costs thereof under and pursuant to the provisions of the Municipal Improvement Act of 1913 the Act"); and WHEREAS, the proposed assessment district, if it is formed, is to be known and designated as Assessment District No. 88-1 the Assessment District"); and WHEREAS, the proposed boundaries of the Assessment District are shown on a map thereof, which indicates by a boundary line the extent of the territory proposed to be included in the Assessment District, which map is designated Proposed Boundaries of Assessment District No. 88-1" the Map"), and which has been presented to the City Council for approval; and WHEREAS, before ordering the proposed improvements, the City Council is required, under the Act, to adopt a resolution declaring its intention to do so; NOW, THEREFORE, the City Council of the City of La Quinta DOES HEREBY FIND, DETERMINE, RESOLVE, AND ORDER as follows: SECTION 1. SECTION 4. The improvements which the City Council intends to construct the Improvements") generally include the following: Storm Drain System. The system shall consist of reinforced concrete pipe varying in size from 18 inch diameter to 66 inch diameter, various manholes and catch basins to be constructed in Calle Colima, Avenida Mendoza and Calle Madrid. Street System. The street system shall be reconstructed within all of the boundaries of the district described as lying southerly of the northerly line of parcels having frontage on Calle Madrid. The construction as proposed consists of installation of curb, gutter, paving of roadway section with a minimum of 3 inch of A.C. paving on native material on local streets, 3 inch of A.C. paving over 4 inch of Class 2 Base material on collectors, and 4 inch of A.C. paving over 6 inch of Class 2 Base material on Eisenhower. It includes construction of concrete driveway approaches and reconstruction of existing driveways as may be required to meet grade. It includes removal or relocation of any facilities located now in the area of proposed construction, which if left in place would interfere with the intent of the project. These facilities include but are not limited to the removal or relocation of landscaping, mailboxes, sprinkler systems, trees and shrubs. Water System Improvement. The project proposes to install new and/or replace substandard existing water system in the area south of Calle Madrid. The system to be constructed consists of 18, 12, 8, and 6 inch diameter mains, 1 and 1-1/2 inch services, and fire hydrant assemblies. A median break shall not be permitted at the northerly tract entry, but rather shall be allowed at Sagebrush Avenue." Note: Permanent right-in and right-out access to Washington Street is permitted.) The Washington Street Specific Plan does not specifically prohibit left turn access points along Washington Street; page 43 of the Specific Plan, the third paragraph states, Roadway access for new development proposals shall be based upon applicable standards within the La Quinta General Plan and requirements of the City Engineer, as they relate to a specific project. Proposals shall be reviewed on a case-by-case basis with respect to the guidelines of the study and its standards indicated above. ANALYSIS: 1. In the recent past, conditions of approval for tentative tracts along major arterials have been granted temporary median breaks for home sales which is eliminated within a given time frame. The access then becomes a permanent right-in, right-out access. 2. The Applicants request was transmitted to the Public Works Department for comment. The Department supports a temporary median break but not on a permanent basis. Pursuant to Municipal Code Section 8.08.050, the decision of the Fire Marshall Fire Chief) in the interpretation of the Uniform Fire Code is appealable to the City Council, sitting as a Board of Appeals". In addition to leasable areas, the areas under the roof line which are being used for parking and for pedestrian walkways were added to the gross floor areas to determine whether the building exceeded 5,000 square foot area, which would mandate a sprinkler system. This method of calculating floor area is consistent with the U.B.C. and the U.F.C. The appeal involves the R-3 efficiency unit) located on the second floor of the structure. The ordinance adopted by the City does not include R-3 occupancies. The applicant would like the square footage of the efficiency unit to be excluded from the gross floor area and thus reducing the area to under 5,000 square feet and as a consequence eliminate the sprinkler requirement. Although an R-3 occupancy is not listed in the ordinance, I believe its omission was intended to exclude single family detached dwellings and duplexes from being sprinklered and not dwelling units within a commercial building. The City9 agrees to delete any requirement for participation and/or construction of any signalization." Fiscal Impact: Developer figured $12,000. City's estimate is $25,000 for 1/4 the cost of a 4-way signal at Westward Ho and Dune Palms Road. Comment: While no precedent yet has been set for actual participation in signalization by a single family residential development, several recent tracts have been conditioned to do so. The rationale has been that these developments will create the need for and benefit from the signalization, in which case general fund expenditures would be difficult to justify. The only thing that makes this situation unique is that one quadrant is already developed and a second quadrant is in Indio. Current planning for the third quadrant involves a golf driving range and school. B. The City' agrees that a Low Flow' crossing will be required as per Attachment C-2; that no other requirement will be requested." Fiscal Impact:Developer figured $13,000. City's estimate is $41,000; however, CVWD will determine what will be allowed when hydrology studies are made, and the cost could be different. comment: In subsequent discussions with the developer's representative some consideration may be given to the inclusion of this improvement in an assessment district referred to in Item C. below.
