APPROVING THE OFFICIAL STATEMENT FOR
ASSESSMENT DISTRICT NO. 89-2, IMPROVEMENT
BONDS, SERIES A
BE IT RESOLVED, DETERMINED AND ORDERED that bids be
received on the Assessment District No. 89-2 Improvement Bonds,
Series A on June 15, 1989, that the official statement prepared
by Fieldman, Rolapp & Associates, presented to this City
Council on this date, is approved in substantially the form
presented; that the official statement is authorized to be
mailed to prospective bidders for the Assessment District No.
89-2, Improvement Bonds, Series A with such additions and
corrections thereto as may be necessary to make said official
statement current prior to mailing, together with the Notice of
Sale attached hereto as Exhibit A and that Fieldman, Rolapp &
Associates is authorized to publish a notice of sale in the
Bond Buyer not less than 15 days prior to said sale.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA APPROVING THE OFFICIAL STATEMENT
FOR ASSESSMENT DISTRICT NO. 89-2, IMPROVEMENT
BONDS, SERIES B
BE IT RESOLVED, DETERMINED AND ORDERED that i) it is in
the best interest of the City and Assessment District No. 89-2
that if said assessment district is formed that the Improvement
Bonds, Series B to be issued, which will bear taxable interest,
be sold to an underwriter selected after soliciting
underwriters that may purchase said type of bonds; ii)
Fieldman, Rolapp & Associates, financial consultants to the
City on the proposed Assessment District No. 89-2, are directed
to solicit proposals from underwriters and to present to this
City Council at the hearing on the formation of the assessment
district to be held on June 22, 1989, the name of the
underwriter which, in the opinion of Fieldman, Rolapp &
Associates, will purchase said Bond* at a favorable price to
the City and the price to be paid for said Bonds, if issued;
and iii) the official statement prepared by Fieldman, Rolapp &
Associates, presented to this City Council on this date, is
approved in substantially the form presented. Said official
statement may be presented to underwriters which are being
solicited by Fieldman, Rolapp & Associates to purchase said
Bonds. It is the understanding of this City Council that
Fieldman, Rolapp & Associates will make such additions and
corrections to the official statement as may be necessary to
make said official statement current prior to presentation to
underwriters.

SUBJECT: Bus Shelter Locations
At its May 10, 1989 meeting, the City1s Technical Traffic Committee
reviewed the proposed locations of bus shelters as submitted by
Sunline Transit area Sunrise Media see attached copy of the minutes
of that meeting). As a result, the Committee recommends to the City
Council that the following actions be taken:
1. Southbound Eisenhower at Durango, near side.
Approve
2. Northbound Obregon at Madrid. near side.
Disapprove near side, approve far side.
3. Southbound Washington at 50th, far side.
Approve subject to understanding that buses must pull off
the paved surface.
4. Northbound Washington at 50th, far side.
Disapprove.

SUBJECT: Lot 7 Desert Club Tract Request for Variance of
No. 1 Finish Floor Elevation
The owner of the subject property has requested that he be allowed to
build at an elevation lower than that prescribed by the Flood
Insurance Rate Map FIRM). According to the FIRM, his property is in
the A3 flood zone, which would require a 3 foot pad.
The FIRM under which we are operating does not take into account the
new flood control facilities which have been constructed in the upper
Cove. CVWD officials state that it will be at least six months
before a new FIRM is published which will account for the change
which has been made.
The City Engineer, as the Floodplain Administrator, is not empowered
under the floodplain management ordinance to grant variances. The
City Council, however, acts as an Appeal Board and may grant
variances.
In Section 8.11.060, Variance Procedures, in the Municipal Code it is
stated that generally variances may be issued for new construction
and substantial improvements to be erected on a lot one-half acre or
less in size contiguous to and surrounded by lots with existing
structures constructed below the base flood level. The request for a
variance submitted by Mr. and Mrs. Long meets those criteria.
Therefore, it is recommended that the City Council grant the
requested variance. However, the Municipal Code also states as
follows:
Any applicant to whom a variance is granted shall be given
written notice that the structure will be permitted to be built with
a lowest floor elevation below the regulatory flood elevation and
that the cost of flood insurance will be commensurate with the
increased risk resulting from the reduced lowest floor elevation. A
copy of such notice shall be recorded by the floodplain board in the
office of the Riverside County Recorder and shall be recorded in a
manner so that it appears in the chain of title of the affected
parcel of land."
