Dear Ron:
I wish to express my concern and ask for your help
in slowing down the traffic on Park Avenue. This
past summer, an accidentoccurred when a speeding
car failed to make the curve on Park and went into
the wall. Traffic Continues to travel at excessive
speeds and creates a dangerous situation for traffic
exiting on to Park Avenue.
We are asking that the City act to install speed limit
signs and initiate enforcement before another and
perhaps more serious accident occurs.

BACKGROUND:
Council has indicated the desire to develop the old Desert Club parcel into
a community park. Staff and the Community services Commission cooperated in
selecting and recommending T.I. Maloney of Riverside as the park design
consultant for Fritz B. Burns Community Park.
FISCAL IMPLICATIONS:
The design phase of Fritz Burns Park was included in the budget for Fiscal
Year 91-92 General Fund. Staff will attempt to negotiate an agreement which
costs the City less than $40,000.00.

Staff requests that the Council directs the City Manager or his designee to
proceed with negotiations with T.I. Maloney for design and master plan

On December 3, 1991, the Council accepted the resignation of Robin Merritt
from the Community Services Commission. The Council asked to review the
applications which were submitted in June. Attached are the applications
submitted by the following individuals:

B. J. Betty Jo) Seaton
Pat Cross and B. J. Seaton have asked that they be considered once again,
while Janeil Esmeralda asked that her application be withdraw'n. I was unable
to contact Herb Pachman.
In the meantime, an application was submitted by Robert Metkus, which is also
attached. Jill Thompson also picked up an application, but as of printing
time, it had not been returned.
This particular term expires June 30, 1993.

AN ORDINANCE OF THE CITY OF LA QUINTA,
CALIFORNIA, AMENDING CHAPTERS 2.08.060 and
2.10.030 OF THE LA QUINTA MUNICIPAL CODE,
RELATING TO POWERS AND DUTIES OF THE CITY
MANAGER AND CITY CLERK
WHEREAS, the City Council of the City of La Quinta City
Council") desires to amend Chapters 2.08.060 and 2.10.030
relating the the powers, duties and functions of the City
Manager and City Clerk in order to comport to current practices;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS:
Chapter 2.08 City Mana?er
Section 1. Title 2, Chapter 2.08, Section 2.08.060,
subsection B) of the La Quinta Municipal Code is hereby
amended to read as follows:
B. Appoint, remove, promote and demote any
and all officers and employees of the city except
elective officers, the city attorney and city
clerk, subject to all applicable personnel rules
and regulations which may be adopted by the city
council;
Chapter 2.10 CityClerk
Section 2. Title 2, Chapter 2.10, Section 2.10.030,
subsection B)(6) of the La Quinta Municipal Code is hereby
amended to read as follows:
6. Prepare the council agendas in conjunction
with the city manager;
Section 3. The City Clerk shall certify to the passage
and adoption of this ordinance and shall cause it to be posted
or published in the manner required by law.

are further amended by rezoning from R-1-10 to R-2, that
certain territory within the City and depicted for such
rezoning on the map which is attached and made a part of this
ordinance, and which attached map is labeled Exhibit A
Change of Zone 90-054".
SECTION 2. EFFECTIVE DATE. This Ordinance shall
be in full force and effect thirty 30) days after its
adoption.
SECTION 3. POSTING. The City Clerk shall,
within 15 days after passage of this Ordinance, cause it to
be posted in at least three public places as designated by
Resolution of the City Council; shall certify to the adoption
and posting of this Ordinance; and shall cause this Ordinance
and its certification, together with proof of posting, to be

BACKGROUND:
Bids for the construction of Avenue 52 in the new alignment from
Washington Street to Avenida Bermudas were received on December
10th. The results are as follows:
James E. Simon 178,902.85
Tarmac California, Inc. 197,433.25
E.L. Yeager Construction Co. Inc. 198,611.00
Matich Corporation 203,302.00
James E. Simon Company submitted the lowest responsible bid.
As mentioned in the agenda report to the City Council on October
1, 1991 when authorization to advertise the project for bids was
requested, there is a funding shortfall. Currently, there is
$100,000 budgeted for this project. If the City desires to
proceed with construction utilizing this low bid, the total
project cost will be approximately $227,000, which means there is
a $127,000 funding shortfall. The project costs breakdown as
follows:
Design & Survey $ 28,350
Construction Contract 179,000
Inspection & Soil Testing 9,500
Adjustments & Change Orders 10,000
$ 226,850
The bids received are competitive; additionally, due to reduced
bidding opportunities in the construction industry at this time,
it is not likely the project can be constructed for less at
anytime in the future. Therefore, it is staff's recommendation
that a construction contract be awarded to James E. Simon
Company.
FISCAL IMPLICATIONS: APPROVED BY:
$100,000 is currently budgeted for this project; an additional
$127,000 is needed to complete the project.

BACKGROUND:
In response to issues raised at the November 19 Council Meeting, the deposit
structure is based on a per-facility-used basis snack bar is one facility,
restrooms are one facility, a baseball diamond is another facility, etc.).
The deposit system will be reviewed at the end of six months to gauge
feasibility; and the deposit system is applicable to all City facilities.
Additionally, the question arose regarding the field lights and diamond
preparation, and the fact that the charges are not progressive. Both these
fees are fixed costs. Other fees and charges reflect a progressive
subsidization of the Class I?structure, and park and facility maintenance
costs.
FISCAL IMPLICATIONS:
Undetermined given the lack of history.

BACKGROUND:
This item was last considered at the meeting of November 19, 1991, and continued to
this meeting at the request of the Appilcant. Prior to that meeting, the item was also
considered at the meetings of September 17, and July 16, 1991. At the last meeting,
two tentative tracts which accompanied these applications were tabled at the request
of the Applicant.

Based on action taken at the meeting of December 3, 1991, for other projects within
Annexation area #5, Staff would recommend that you continue consideration of this
item to the meeting of January 7, 1992.

specific plan and parcel map can be taken. Resolutions for approval of the specific
plan and parcel map are attached for your use, if necessary.

ing -> 14 SECOND NOTICE TO PROVIDE TRASH ENCLOSURE
January 6, 1992
The City of La Quinta adopted Sections 6.04.060(B) and
6.04.065(B) of the La Quinta Municipal Code on November 21, 1989
requiring that the owners of commercial property and apartments
with three or more units provide dumpsters and enclosures which
obscure such dumpsters from public view. Please see the enclosed
Ordinance No. 156 which sets forth these requirements.
You were notified on that you
must provide a trash bin enclosure to enclose the dumpsters
located on your property at La
Quinta. You have not provided such an enclosure to date. This
is the City's second and final request that you comply with the
Ordinance.
If you have not provided a trash enclosure which meets the
requirements of the Ordinance on or before February 3, 1992, the
City will begin immediate prosecution of your violation of this
Ordinance. Violation of this Ordinance is designated as an
infraction which is punishable by a fine of up to $50 for a first
offense and $100 for a second offense. A separate offense is
committed on each and every day during which the property owner
fails to comply with this Ordinance. A third violation is
prosecutable as a misdemeanor, as is each subsequent violation.
Misdemeanors are punishable by a fine of up to $1000 and
imprisonment in county jail for six months.

I?e wish to protest the proposed General Plan ndrrent: 91-037, Zone
Change: 91-065, Enviroi?nental Assessment: 91-210. Our reasons for opposing
these land use issues are:
1. There is abundant Conmercial land available at other sites in
the City of La Quinta for this project.
2. The location of the zone change will increase traffic and other
hazards on Washington Street.
3. A full EIR needs to be cormussioned in order to assess the true
ippact of this project on the Conmunity.
