AN ORDINANCE OF THE CITY OF LA QUINTA,
CALIFORNIA AMENDING THE LA QUINTA MUNICIPAL
CODE BY ADDING CHAPTER 6.12 RELATING TO THE
REGULATION OF SMOKING IN PUBLIC PLACES
WHEREAS, the City Council of the City of La Quinta City
Council") finds that numerous studies have found that tobacco
smoke is a major contributor to indoor air pollution; and
WHEREAS, the City Council finds that reliable studies have
shown that breathing second-hand smoke is a cause of disease,
including lung cancer, in healthy nonsmokers. At special risk
are elderly people, individuals with cardiovascular disease,
and individuals with impaired respiratory function, including
asthmatics and those with obstructive airway disease; and
WHEREAS, the City Council funds that health hazards induced
by breathing second-hand smoke include lung cancer, respiratory
infection, decreased exercise tolerance, decreased respiratory
function, bronchoconstriction, and bronchospasm; and
WHEREAS, the Legislature of the State of California has
declared that tobacco smoke is a hazard to the health of the
general public; and
WHEREAS, the Legislature of the State of California has
declared its intent not to preempt the field of regulation of
the smoking of tobacco and has authorized cities to completely
ban or regulate smoking; and
WHEREAS, the City Council finds and declares that the
purposes of this ordinance are 1) to protect the public health
and welfare by prohibiting smoking in public places except in
designated smoking areas, and by regulating smoking in places
of employment; and 2) to strike a reasonable balance between
the needs of persons who smoke and the need of non-smokers to
breath smoke-free air, and to recognize that, where these needs
conflict, the need to breathe smoke-free air shall have
priority.
NOW, THEREFORE, THE CITY COUNCIL DOES HEREBY ORDAIN AS
FOLLOWS:
Section 1. Chapter 6.12 is hereby added to the La Quinta
Municipal Code as follows:

into the costs, the Committee has found that a tile plaque similar to the
one the City gives to out-going Commissioners) would be nicer and more

STUDY SESSION:
BACKGROUND:
The Shopping Center/Office Complex proposed by The Tucker
Companies will require significant off-site infrastructure
improvements to serve this development. One of the off-site
streets effected by the proposed shopping center is State Highway
ill, which means Caltrans is the agency responsible for
determining the nature and character of the improvements that
will be needed for Highway 111.
Caltrans? planning process for highway improvements related to a
shopping center this size can take 6 to 12 months. Caltrans'
planning process is performed at no cost to the City. However,
because the process is extensive and costly, Caltrans withholds
initiation of the process until formally requested by a City
Council. By doing so, Caltrans eliminates hundreds of frivolous
requests for studies that might otherwise occur if the process
were not restricted in some manner.
A resolution adopted by the City Council is the type of formal
request that satisfies Caltrans.

The Desert Charities Foundation is requesting special advertising

at the La Quinta Country Club & PGA West Golf Course.
The Applicant has also requested that the City waive the City
application fees for this event.

BACKGROUND:
Carlacio Landscape Inc.(CLI), of Bermudas Dunes formerly
Southview Landscape) currently has the annual maintenance
contract for the Sports Complex. The contract with CLI began
in July 1990 and carried through to June 1991. Since June,
maintenance at the Sport Complex has been extended month by month
as provided in the contract and mutually agreed by the City and
CLI.
On December 30, 1991, three bids were received for the new annual
maintenance contract. The bid submitted by Sunshine Landscape
was non-responsive because a bid bond was not included with the
bid; their bid was $4,926.00 per month. The other bids are as
follows:
Karleskint-Crum Inc. $6,049.00 per month
Environmental Care, Inc. $9,231.96 per month
Karleskint-Crum Inc., is the lowest responsible bidder.
However, because of reduced work schedules in and around the
holidays, contractors and their suppliers found it difficult to
meet the bid preparation requirements and apparently either
choose to forego the bid or were unable to comply with the
requirements. One bid was rejected by the City Clerk because it
was submitted five minutes late and two contractors who attended
the mandatory pre-bid walk-through meeting did not bid.
FISCAL IMPLICATIONS: APPROVED BY:
There is not sufficent funds in the budget to award a six 6)
month contract at $6,049 per month. The current contract with
CLI is $3,769.70 per month.
RECOMMENDATION:
It is recommended that the City Council take the following
actions:
1. Reject all bids.
2. Authorize the City Clerk to readvertise the contract for
new bids.

Because Riverside County was not sure whether or not they were going to
continue funding the Outreach Program, agreements for only the first quarter
were sent out. That first quarter agreement was approved by the Council on
September 17, 1991. Since that time, the County has determined that they
will continue funding the program. Therefore1 the attached agreement covers
the period of October 1, 1991 through June 30, 1992. The amount of funds
forthcoming to the City under this agreement is $4,681.

practices as an aid to business and for the information of the

9.212.020 Permit reQuirements and review rocedures-
Signs on rivate DroDerty--Permit required. Sign permit
approval from the planning and development department is
required prior to obtaining a building permit for the placing,
erecting, moving, reconstructing, altering, or displaying any
sign on private property within the city, unless the review
procedure is exempt under Section 9.212.080 of this chapter, or
other provisions of this chapter. Signs requiring approval
shall comply with the provisions of this chapter and all other
applicable laws and ordinances. Signs legally existing prior
to the effective date of the ordinance codified in this chapter
shall not require approval until such time as the sign is
moved, structurally altered, changed or relocated; at which

At its meeting on November 25, 1991, CVAG's Executive
Committee voted to delay action on the attached draft #3
of the Draft Implementation procedures for Growth
Management until its next meeting on January 27, 1992. It
also voted to request each jurisdiction to formally
comment to CVAG on this document two weeks before the
meeting so the comments can be part of that meeting's
agenda packet.

BOARD ACTIONS
1. The board approved staff's recommendation to hire a
part-time taxi starter to provide SunLine Regulatory
Administration enforcement at the Palm Springs Airport.
This person would be placed at the airport during peak hours
to monitor taxi operations to assure compliance with all
provisions of the Ordinance. This employee would also serve
as a starter' for taxis awaiting fares at ti?e A
2. The board voted to receive and file the Agency's first
quarter performance report for FY 1992. Basically, the
system in aggregate is operating well and on target.
3. The board approved staff's recommendation to adopt urgency
Ordinance No. 91-4 which defines the term contract service"
and sets certain conditions under which contract service"
can be operated as it relates to taxi operators providing,
what Ordinance 91-1 termed, charter service". This change
is designed to clear up some confusion regarding
terminology.
INFORMATION ITEMS
1. SunLine's new Director of Transportation, Ray Grosclaude,
was introduced to the board. Mr. Grosclaude started in this
position November 25 after relocating from Cedar Rapids,
Iowa.
2. The board honored Diana Riddle, compliance clerk, who has
been with the Agency for 10 years with a variety of
responsibilities regarding personnel and payroll matters.
3. The SRA informed the board that a situation we had reported
on last month regarding a taxicab operator who was in
violation of our ordinance regarding sealing of meters has
been resolved to everyone's satisfaction.
4. The CvJPIA recently did an audit of TPA's. We were pleased
to report to the board that Wear & Wood, Inc. who handles
our Worker's Comp. claims) performed excellent in all 41
cases tested.

The Apphcant has requested a redesignation of the property from Very Low Density
Residential R-1 20,000 SFR) to Low Density Residential R-1 8,000 SFR) for +39
acres of land located on the east side of Madison Street, 1/4 mile south of 54th
Avenue. Tentative Tract 27224 requests the division of property into 98 single
family lots. The Planning Commission recommended denial of both the GPA and CZ at
their meeting of October 22, 1991, and approval of the Tentative Tract provided R-1
20,000 lots are allowed. On October 29, 1991, the Applicant requested an appeal of
the Planning Commission action. On November 19, 1991, and December 3, 1991, the
City Council continued the project to January 7, 1992.

BACKGROUND:
The property is presently used for agricultural purposes. The
applicant/owner would like to subdivide the property into B lots which
meet the R-l 20,000 square foot) minimum requirements, however, the
property is in the Equestrian Overlay Zone which prescribes a minimum
lot size of 1.5 acres. The Green Valley Ranches Association at the
Planning Commission meeting of September 24, 1991, requested that the
subdivision of this land not be less than lots of 1.5 acres. The
Planning Commission approved this case at their meeting of September
24, 1991, with the provision that the lots be a minimum of 1.5 acres
in size. On December 3, 1991, the City Council continued the project
to January 7, 1992.
