Torres-Martinez Desert Cahuilla Indian Tribe
Regarding Right of Way for Highway 86.

FISCAL IMPLICATION:
None for this action.
BACKGROUND AND OVERVIEW:
The State of California, through Caltrans, has negotiated a Memorandum of
Understanding MOU) with the Torres-Martinez Tribe for acquisition of Rights of Way
in order to proceed with improvements to Highway 86 Attachment 1). As drafted,
the MOU indicates that the State will not contest Tribal acquisition of land, to become
sovereign land, in exchange for Rights of Way to construct Highway 86
improvements.
CVAG considered a Resolution supporting the MOU at its meeting of October 27 see
Attachment 2). The Riverside County Transportation Commission urged CVAG to
approve the Resolution Attachment 3). After much discussion, CVAG authorized a
letter to the Governor indicating that CVAG was not involved in local land use issues
Attachment 4).
The Torres-Martinez Tribe has historically indicated interest in acquiring lands within
La Quinta. Congressman Bono introduced legislation last year that would have settled
pending claims of the Tribe with Valley Water Districts. The Tribe, as part of those
settlement proposals, identified primary acquisition" boundaries for possible Tribal
acquisition including portions of La Quinta, but agreed to language that would have
provided local jurisdictions with virtual veto power over acquisition of lands within
City boundaries. At this juncture of the Highway 86 negotiation, however, the Tribe
is taking the position that local jurisdictions should not have veto authority over Tribal
acquisition of sovereign lands. The MOU suggests that Caltrans and the Tribe intend
to specifically identify parcels for tribal acquisition prior to executing the MOU.

ing -> 11nlThe Tribe has not disclosed its intentions with regard to future property acquisition
as of this writing. CVAG has indicated that it is not involved with local land use
issues. Thus, it is left to the Department of the Interior, the State of California and,
possibly, local jurisdictions to determine the merit of Tribal proposals.
Given the above, staff has drafted a letter to Governor Wilson, copying Caltrans,
CVAG and the Torres-Martinez Tribe, reiterating the City's position regarding possible
acquisition and conversion of lands within La Quinta to sovereign tribal property.
Staff submits this draft letter to the City Council for review and comment.
FINDINGS AND ALTERNATIVES:
Alternatives available to the City Council include:
1. Authorize staff to forward the letter as drafted to Governor Wilson;
2. Authorize staff to forward an amended letter to Governor Wilson;
3. Take no action at this time; or,
4. Provide staff with alternative direction.

RECOMMENDATION:
Adopt the Resolution as submitted accepting a donation to the La Quinta Senior
Center, and authorize the expenditure of $929 from the Civic Center Bond Refunding
Account, # 401-654-609-553 for the installation of window tinting at the Senior
Center.
FISCAL IMPLICATIONS:
The total cost associated with the installation of window tinting at the Senior Center
is $1,858 Attachment 1). The Friends of the La Quinta Senior Center have agreed
to pay $929 towards that cost. The remaining $929 will be paid by the City, utilizing
funds from the Civic Center Bond Refunding Account. The estimated unencumbered
balance of that account including this expenditure, as well as the recently approved
emergency generator at the Senior Center, would be $509,959.
BACKGROUND AND OVERVIEW:
The Friends of the La Quinta Senior Center is a non-profit organization which was
formed for the purpose of providing various supplies and equipment to the Senior
Center, which otherwise might not be made available. The Friends are requesting that
tinting be installed on certain windows at the Senior Center to reduce unwanted glare,
reduce temperatures and enhance movie viewing at the facility. The Friends are
offering to pay one half of the cost associated with installation of the tinting.
The attached resolution will accept the donation of $929 worth of window tinting
from the Friends.

The following are responses to public comments made at the October 21' 1 997 City
Council meeting:
1. Mr. John Pena spoke regarding funding assistance for tinting of the windows
at the Senior Center.
* Staff was directed to agendize this matter for the Council's
consideration. This item has been placed on the November 4th agenda.
In addition, staff met with Mr. Pena on this matter.

RE: Update on Preparations for El Nino
In an effort to prepare for the potential effects of El Nino, which could
produce up to three times the normal annual rainfall this winter, the following
precautions have been taken within the City:
* Attended the National Weather Service briefing on the subject which
addressed rainfall predictions and estimated time frame of the
phenomenon.
* Encouraged self reliance of the citizenry through Post articles stressing
preparedness. Reproduced Desert Sun article identifying precautions
for distribution at the public counter.
* Coordinated with the Riverside County Fire Department to insure that
sand bags are available at all stations within the City. Currently 2,000
at each station with 20,000 available at Sunline for backup)
* Purchased an additional 1 O00 sand bags for a total of 3,000 for use
by City crews, or as additional backup to Fire Department supplies.
* Sand will be placed at Station 32 and Station 70 for use by La Quinta
residents to fill bags.
* Continued ongoing maintenance of storm drains in the City.
* Verified working condition of City owned water pumps two pumps)
* In the process of acquiring an additional water pump 6'?) for use at
known problem areas. such as Washington St at the Church)

* The trash racks and invert of the Rondo drainage ditch have been
cleared of trash and debris.
* Staff has coordinated with representatives of J.M. Peters to clear plant
growth on the golf course side of the Rondo drainage ditch overflow
grates.
* Repaired roof leaks at the Civic Center, Senior Center and the Kidsline
trailer.
* Staff is scheduled to participate in a seminar regarding sand bagging
techniques.
Staff is also pursuing the possibility of acquiring a sand bag filling apparatus
that would be attached to the rear of a dump truck, and greatly decrease the
time and effort associated with filling the bag by conventional methods.
Because of the associated cost of this equipment $10,000-i 5,000) and the
limited need for such a tool, staff is looking in to the option of sharing the
unit and the cost with other jurisdictions in the eastern Valley.
Staff will continue to stay in close contact with other emergency managers
in the valley and to monitor issues and concerns that may arise in conjunction
with El Nino.
