FISCAL IMPLICATIONS: None BACKGROUND AND OVERVIEW: At its April 21, 1 998 meeting, the Council directed that the City Library Committee CLC) review library alternatives in light of the current status of selecting a library building. The CLC met on April 24, 1 998 and discussed the current status of efforts to select a site for the new library. Previously, the CLC and the City Council informed the County that the vacant Mario's Cafe was the preferred site for a library building. The County's process to identify sites suitable for a library as called for in the Memorandum of Understanding MOU) for library services, has identified two potential sites: the Walmart shop building and the vacant Mario's Cafe. The Mario's site is complicated by the fact that the owner/broker is interested in a five year lease, not a one year lease as sought by the County and consistent with the terms of the MOU. The County has also expressed concerns with the Mario's site regarding handicapped accessibility, building maintenance, and improvement costs. The County recently submitted a letter to the City Attachment No.1) which provides an update on their actions. The CLC reviewed this letter, and one from the Chamber Attachment No.2) at its meeting of April 24?h At that meeting, the CLC voted unanimously to recommend to the Council that the MOU be extended to cover a three 3) year term, rather BIB] 01-21-2000-U01 08:22:01AM-U01 ADMIN-U01 CC-U02 APR-U02 28-U02 1998-U02 Jgcurrent one year term to address concerns over a lease term with the Mario's site if that site is selected. The CLC further recommended that in the event the Mario's site may not become available, for whatever reason, that the matter immediately be reviewed by the CLC for further recommendations to the City Council. If the Council agrees to extend the MOU to a three year term, as currently written, the City would remain in the County Library System until June 30, 2001. The Council could direct staff to renegotiate the terms of the MOU with the County for future Council consideration. The CLC also discussed the what if" scenario of Mario's not being available for the new library. To address that, one option discussed was contacting the landlord for the current library building to discuss extending the lease term beyond the June 30, 1 998 lease ending date and exploring the possibilities of expanding the current space There is approximately another 1,500 square feet available on the ground floor of the existing library building). It was represented at the CLC meeting that the existing library building may be in the process of being sold. Coincidentally, shortly after the CLC meeting on April 24th, staff was contacted by Mr. Wells Marvin who indicated that he is buying the Bogan Villas Building and the library building. Mr. Marvin expressed his desire to work with the County/City on keeping the library in its present location and expanding the library's space, possibly to include upstairs. Mr. Marvin was advised of the Council Meeting scheduled for April 28th and he indicated he would be present. In light of the library's expiring lease on June 30, 1998, the Council may wish to consider pursuing the option of making a recommendation to the County of utilizing the existing library building in some manner or fashion, whether temporary or of a more long-term nature. FINDINGS AND ALTERNATIVES: Options available to the City Council include: 1. Review the recommendation of the CLC and direct staff to communicate the Council's desire to the County; or 2 Take no action at this time, or 3 /dealte;)na;>dlrection to staff. Britt W. PUBLIC HEARING: Discussion of Transfer Stations RECOMMENDATION: As deemed appropriate by the City Council. FISCAL IMPLICATIONS: None. BACKGROUND AND OVERVIEW: The Transfer StationlMRF Material Recovery Facility) Task Force coordinated through CVAG,) worked for three years 1994-1996) to plan a regional solution to the closure of the Coachella Landfill in 1997 and the Edom Hill Landfill in 2001. The Task Force consisted of representatives appointed by the city councils of all nine Coachella Valley cities plus a representative appointed by the County Board of Supervisors. The Task Force researched and analyzed options, and determined that a mid-valley transfer station with limited MRF capability should be built and operated by the jurisdictions through a JPA Joint Powers Authority). The Task Force issued an RFP for the design, operation, and construction management of a mid-valley transfer station with limited MRF capability, and selected two vendors for contract negotiations. Contracts were negotiated with both vendors with final selection to be made by the JPA. In early 1997, the JPA Agreement, developed by the Task Force, was submitted to each of the City Councils and the Board of Supervisors. As the JPA was not formed to pursue a regional mid-valley transfer station, the issue was tabled. Coachella Landfill Closed The Coachella Landfill closed in May 1997, and the East Valley waste was re-routed to the Edom Hill Landfill for disposal. At the time of the Coachella Landfill closure, the Edom Hill Landfill was permitted by the California Integrated Waste Management Board CIWMB) to CCJH004 flfl()fli? Even with the additional waste from the East Valley, exceeding the Edom Hill Landfill's 1,200 ton permitted maximum daily tonnage limit during the summer months low season") was not an issue. However, during September and October, the permitted maximum daily tonnage limit was exceeded on most days. The Riverside County Waste Resources Management District District) filed an application with the CIWMB to revise the Edom Hill Landfill permit in order to, 1) vertically expand the Landfill, and 2) increase the daily tonnage limit. On November 12,1997, the CIWMB approved a revised solid waste facility permit for the Edom Hill Landfill which, 1) allows a 40-foot vertical expansion of the Landfill which would keep it open until approximately 2006, and 2) increased the daily tonnage that can be accepted at the landfill from 1,200 tons per day to 2,651 tons per day. Update on Coachella Valley Transfer Station Projects Coachel Ia. The City of Coachella has signed a lease agreement with the District for $1 per year allowing the City of Coachella to build a transfer station at the closed Coachella Landfill site the waste must be delivered to a District landfill for six years). On April 15, 1998, the City of Coachella awarded a contract to build and operate an enclosed transfer station at the closed Coachella Landfill to Fontana-based Burrtec Waste Industries. Burrtec is a Western United States regional solid waste hauler with experience in transfer, collection and recycling of solid waste. Burrtec has experience in the operation of transfer stations and materials recovery facilities, including operation of a transfer station in San Diego County. In order for the proposed transfer station to be feasible, it must process 200 tons per day. However, the City is hoping to process 300 tons per day at approximately $38.50 per ton. The City of Coachella generates approximately 50 tons per day. Burrtec representatives had met briefly with La Quinta City staff and other cities' staff in February. Now that the contract has been awarded, it is anticipated that Burrtec will be approaching the City of La Quinta with a contract to commit waste to the transfer station. As with other similar contracts, it would be a starting point for negotiation and should be evaluated as such. If it is determined that the CoachellalBurrtec transfer station is a potential option for the City, the most favorable terms and costs should be negotiated for La Quinta and included in the final contract. Attached is a copy of the Burrtec Agreement with the District Attachment 1). The City of Coachella has offered to arrange a field trip to the site, if so desired by the City Council. CabazonlBLT. The Cabazon Band of Mission Indians has joined together with BLT Enterprises to design, build and operate a transfer station on Cabazon land on the west side of Dillon Road between Highway 111 and State Highway 86. BLT Enterprises operates a large transfer station in Los Angeles, and the City of Oxnard owned transfer stationlMRF. BLT has provided a videotape of their Oxnard operation. The tape is available for viewing in the Community Development Department. In addition, BLT has offered to arrange a field trip to their Oxnard facility, if so desired by the City Council. The transfer station needs a minimum of 200 tons per day. It is estimated that the cost for the facility would be $38.50 per ton with 5% diversion through recycling. It is proposed that solid waste would be transferred to a landfill and clean green waste loads would be transferred to Colmac for burning from waste to energy. The facility would be part of the Cabazons planned Resource Recovery Park. Staff has made a preliminary review of the agreement, and there are numerous clauses that would need to be examined, modified, rewritten, added, and/or deleted in order to protect the City. Such clauses include performance standards, pass-through of costs provisions, verification of increases in costs provisions, hours of operation, self-haul waste costs and provisions, change in law provisions, reporting requirements, payment obligations, escalation index, adjustments to the facility tipping fee, etc. OttolSierra. Otto/Sexton had submitted a transfer station/MRF proposal to the Transfer Station Task Force, and was selected as one of the two finalists. The joint venture is now Otto/Sierra. The John F. Otto Company has experience in designing, permitting, and building transfer stations and material recovery facilities, including the County of Placer transfer station/MRF. Sierra Environmental Services was formed in 1997 by three former BFI corporate managers. The three Sierra principals have extensive experience in the design, permitting, and operation of transfer stations and material recovery facilities. Otto/Sierra is prepared to privately finance, own and operate a mid-valley transfer station/MRF once they have received waste flow commitments resulting in 400 tons per day. The Otto/Sierra Joint Venture has submitted a draft agreement, and a list of the key elements of the agreement comparing the formation of the previous JPA and current proposed agreement. Those items are attached for CounQil review Attachment 3). Palm Springs. In 1996 and early 1997, the City of Palm Springs evaluated a bioconversion facility, Bedminster, that would process and create compost from municipal solid waste and sludge. It was determined that the cost to construct and operate the facility over a 20 year period would be approximately $96 per ton. The negotiations with Bed minster were terminated in mid-i 997. Currently, the City of Palm Springs is working with their hauler, Palm Springs Disposal, to develop a facility to divert approximately 50% of the incoming waste stream through both composting and recycling. The hauler would implement wet/dry collection routes. The wet" routes containing food waste, green waste, soiled and nonrecyclable paper) would be composted at the facility through the Herhof composting process. The dry" route contains easy to recover recyclables because the food waste wet material) is excluded. The dry routes would be sorted at the facility through the material recovery MRF) portion of the facility. Palm Springs Disposal also serves the City of Desert Hot Springs. Therefore, Desert Hot Springs' waste would also be collected through wet/dry routing and sent to this facility for processing. It is estimated that the cost for this facility would be approximately $48-$49 per ton. The City of Palm Springs is willing to speak with other cities regarding utilizing the proposed facility; however, Palm Springs is not actively recruiting waste flow commitments from other cities. The proposed facility is being planned such that the combined tonnage from Palm Springs and Desert Hot Springs would make it a viable project. lndio. In the first week of November 1997, the lndio City Council voted to terminate plans to continue pursuing a transfer station within the City. lndio had been working for over a year with BLT Enterprises on siting and building a transfer station. The lndio City Council rejected a proposed agreement with BLT Enterprises, and ordered work to stop on finalizing the environmental impact report for the transfer station project. Need to Pursue Transfer Station The refuse rates for La Quinta did not increase with the closure of the Coachella Landfill since this occurrence was planned for in the City's negotiation of the new Refuse Franchise Agreement. Therefore, for the short term La Quir?ta refuse rates should remain stable. The stated policy of the Cathedral City Council is to close the Edom Hill Landfill as it interferes with Cathedral City's future development and is not consistent with the development planned for North of 1-10 in the CiWs General Plan. Cathedral City has filed lawsuits against the District related to the expansion of the Edom Hill Landfill. Even if Cathedral City's current lawsuits fail, La Quinta should not plan on the Edom Hill Landfill remaining open beyond 2006 the estimated closure date with the 40-foot vertical expansion). At the current time, the Edom Hill Landfill is the only option available for waste disposal in the Coachella Valley. If it were to close, the nearest available waste disposal option would be either the Badlands or Lamb's Canyon Landfills which are over 50 miles one way direct haul on freeways. Direct hauling to either Badlands or Lamb's Canyon Landfills would cause La Quinta's refuse rates to dramatically increases. With environmental review, permitting, construction, and start-up, a transfer station could take up to two years to be fully operational. Therefore, if started today, a transfer station may not be fully operational until mid-2000. In addition to offering an alternate local disposal option, a transfer station offers flexibility, in selection of a landfill for waste disposal. If the District's landfill tipping fees were to go up, the transfer station could route the waste to a more cost effective landfill, if this option were part of our agreement. 000013 BIB] 01-21-2000-U01 08:22:01AM-U01 ADMIN-U01 CC-U02 APR-U02 28-U02 1998-U02 JgIn 1993, the District was planning to raise the landfill tipping fees to $42.50 per ton. However, due to the Task Force's progress toward construction of a transfer station which would have allowed the use of landfills with tip fees as low as $16-22 per ton), the District cut the landfill tipping fees to $30.00 per ton. With the loss of pressure from the Task Force, rising regulatory costs, and an aging landfill system, the District may raise landfill tipping fees as soon as July 1, or at a future date. With no available cost effective disposal alternative at this time, La Quinta would have no choice but to continue using the Edom Hill Landfill at a higher tipping fee. A transfer station would offer the Coachella Valley cities the opportunity to contract with a distant landfill to obtain Comprehensive Environmental Response, Compensation and Liability Act CERCLA) and Supenfund indemnification and a fixed schedule of tipping fees at a lower rate than the cities are currently paying at the Edom Hill Landfill. The approval of the expansion of the Edom Hill Landfill has granted the Coachella Valley a window of opportunity to pursue a transfer station. This window of opportunity allows La Quinta to pursue the most cost effective transfer station deal for its residents and businesses. If La Quinta does not pursue a transfer station at this time, a crisis may occur that would cause La Quinta to negotiate a less favorable deal than could be negotiated during the current window of opportunity. For example, a crisis could occur if Cathedral City is successful in closing the Edom Hill Landfill, or if an environmental disaster occurs. In addition, a crisis could occur if the District were to raise landfill tipping fees at the Edom Hill Landfill as currently La Quinta has no other alternative than disposing at the Edom Hill Landfill. In these cases, La Quinta may be forced to quickly sign transfer station and/or landfill contract(s). This could result in arrangements or contracts for transfer station and landfill capacity that are very disadvantageous to the City; but, the City would have to agree to the terms due to lack of an alternative method of handling the solid waste; other than direct hauling to an out-of-area landfill. Such arrangements or contract terms could include. + High tipping fees at a transfer station and/or landfill without caps or controls on cost increases now, or in the future. * The duration of the arrangements or contracts may be longer than would be advantageous to La Quinta, and there may be no ability to rebid or negotiate. * The City may not have the ability to rescind the contract or arrangements if a more cost effective solution became available in the future. * Lack of CERCLA or Superfund indemnification. * Put or pay" provisions requiring the City to pay for transfer and disposal of minimum quantity of waste even if it is being recycled and diverted from the landfill to meet AB 939 requirements. 000614 BIB] 01-21-2000-U01 08:22:01AM-U01 ADMIN-U01 CC-U02 APR-U02 28-U02 1998-U02 JgThe most prudent course of action would be to take advantage of the current window of opportunity to negotiate the best transfer station deal for La Quinta.
