CC Resolution 1982-069'k RESOLUTION NO.82-69 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING AN AGREE- MENT WITH THE COUNTY OF RIVERSIDE FOR ANIMAL CONTROL SERVICES. BE IT RESOLVED by the City Council of the City of La Quinta, California, to approve an Agreement for Animal Control Services between the County of Riverside and the City of La Quinta, and to authorize the Mayor to execute the Agr?ement on behalf of the City of La Quinta. ATTEST: CITY L?K APPROVED AS TO FORM: APPROVED AS TO CONTENT CITY ATTORNEY CITY MA?AGER BIB] 04-24-1996-U01 09:40:02AM-U01 CCRES-U02 82-U02 69-U02 'k 1 JOINT POWERS AGREEMENT FOR SERVICES RELATIVE TO REGULATION AND CONTROL OF 2 DOGS AND OTHER DOMESTIC ANIMALS 3 4 THIS AGREEMENT, entered into pursuant to the provisions of Title, 1, Division 7, Chapter 5, Article 1 Section 6500, et. 5 seq.) of the Government Code, relating to joint exercise of powers between the COUNTY OF RIVERSIDE. herein called County' 6 and the CITY OF LA QUINTA, herein called City.? 7 WITNESSETH 8 WHEREAS, it is to the mutual benefit and in the best interest of County and City to join together to establish this 9 Joint Powers Agreement to accomplish the purposes hereinafter set forth; and 10 WHEREAS, County and City have the common power to 11 regulate and control dogs and other domestic animals; and 12 WHEREAS, City is desirous of County providing certain services relative to the regulation and control of dogs and other 13 domestic animals and County is desirous of providing such services; 14 NOW, THEREFORE, the parties hereto do mutually agree as 15 follows: 16 1. City has adopted its Ordinance No. 10 prescribing procedures and standards for the licensing, impounding, 17 regulation and control of dogs and other domestic animals substantially identical to those set forth in County Ordinance 18 No. 455, as amended, and shall maintain the same in force so long as this agreement shall remain in force. Two certified copies of 19 such ordinance, and of any ordinance amending or repealing the same, shall forthwith upon adoption be furnished to County; one of 20 said copies to be furnished to the County Health Officer, and the other to the Clerk of the Board of Supervisors. 21 2. County shall impound and care for all dogs and other 22 domestic animals delivered to it at the animal control shelter facilities located at 45-355 Van Buren Street, India, California. 23 3. County may humanely destroy any dog or cat and dispose 24 of the remains at the request of the owner, upon payment by the owner of the fees for such destruction and disposal as set forth 2? in Section 7(a) of County Ordinance No. 455, as amended. County shall issue receipts for all such fees collected and keep copies 26 thereof. All destruction and disposal fees so collected shall be retained by County. 27 4. County shall collect from animal owners and others 28 for dogs redeemed the impound fees and charges as set forth in G?RALD J. County shall issue receipts for all such fees and charges collected, and 2 shall keep copies thereof. All impound fees and charges so collected shall be retained by County. 3 5. As to any animal delivered to County by a designated 4 city official, which is not redeemed by its owner or another, the unpaid fees and charges for impounding, maintaining the animal 5 and for its destruction and disposal shall be charged to City at the rates specified in paragraphs 3 and 4 herein? and shall be 6 paid by City upon monthly accounting and billing by County. 7 6. In the event County is unable to collect any fee, charge Cr portion thereof from an owner of an animal within the 8 boundaries of City, by virtue of any lower rates established by City, County shall collect the City's rates from such person, and 9 the difference shall be paid by City upon monthly accounting and billing by County. 10 7. Upon the request of City, County shall perform such 11 other services relating to the control of dogs and other domestic animals as prescribed by the provisions of County Ordinance No. 12 455, as amended, at a cost to City of 24.96 per hour plus mileage at 39 cents per mile, provided that all such services performed 13 after 5:00 p.m., Mondays through Fridays, or performed at any time on Saturdays, Sundays or holidays, shall be classified as emergency 14 service, the per hour cost of which shall be computed at 1 1/2 times the hourly rate in effect at the time the emergency service 15 was performed plus associated mileage computed at the mileage rate in effect at the time the emergency service was performed. ie All emergency service must be authorized by the City Manager or his designated representative. county shall submit a billing to 17 City, on a monthly basis, for costs incurred during the immediate preceding month and said billing shall include the hours of such 18 services provided, the nature of such services and the mileage incurred. 19 8. The services provided by County shall be performed 20 by County personnel under the control of County. City shall have the right to inspect County's records pertaining to the services 21 rendered pursuant to this agreement. To the extent that City officers or employees may voluntarily participate in any of the 22 activities herein provided for, or that peace officers of City shall be called upon to render aid or assistance within the 23 boundaries of City or otherwise to perform law enforcement functions the expenses thereof shall be borne by City. 24 9. Upon request of City, County may issue City dog 25 licenses and licenses to operate a dog kennel or pet shop, and collect fees in connection therewith, for dogs, dog kennels and 26 pet shops within City. City shall provide, at its expense, its own forms and tags for such licenses. Not?ithstanding any provisions herein contained, City shall be responsible for the payment of veterinarian fees incurred 2 as a result of the enforcement of penal Code Section 597(f). 3 11. This agreement shall becOme effective January 1, 1983, and shall terminate on June 30, 1983, except that either party to 4 this agreement may terminate its obligation hereunder upon 60 days written notice to the other. Further, this agreement shall be 5 autornatically renewed on a year to year basis on the annual termination date thereof, subject to cancellation by either party 6 upon 60 days written notice to the other. 7 12. Each party shall hold the other party harmless from liability or damages resulting from its own acts or omissions or those of its officers or employees in the performance of this agreement. 9 13. This agreement is intended by the parties hereto as a 10 final expression of their understanding with respect to the subject matter hereof and as a complete and exclusive statement of the 11 provisions thereof and supersedes any and all prior and contemporan- eous agreements and understandings, oral or written, in connection 12 therewith.
