CC Resolution 1984-070) RESOLUTION NO. 84-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA DIRECTING THAT IMPACT MITIGATION FEES PAID TO DESERT SANDS UNIFIED SCHOOL DISTRICT NOT BE SPENT FOR SCHOOLS LOCATED WITHIN THE CITY OF INDIO. WHEREAS, on March 6, 1984 this City Council adopted Resolution No. 84-14 providing for mitigation of school impaction by new residential developments on the Desert Sands Unified School District; and WHEREAS, pursuant to said Resolution No. 84-14, the City Council established a policy whereby certain new residential development within the City shall not be approved unless and until its' developers and said school district have agreed in writing to a means by which the i?paction caused by the construction and occupation of such project will be adequately mitigated; and that no building permit shall be issued for such new development of a residential unit unless and until the applicant provides evidence of payment to said school district of the amount determined by the district as necessary to mitigate school impaction caused by such development; and WHEREAS, resolutions similar to La Quinta Resolution No. 84-14, providing for mitigation of local school impaction, have been adopted by other cities and the County within the Desert Sands Unified School District, including the cities of Indian Wells, Palm Desert, and Rancho Mirage, but no such similar resolution or policy determination has been adopted by the City of Indio; and WHEREAS, inasmuch as the City of Indio has chosen not to provide for itigation of school impaction on the Desert Sands Unified School District, it would be inherently unfair and inequitable for mitigation fees an? funds obtained from development within the cooperating cities and County to be spent on and for schools located within the City of Indio; NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of La Quinta as follows: 1. The City Council hereby finds, determines and establishes the policy that no funds paid to the Desert Sands Unified School District in mitigation of school impaction caused by development within the City of La Quinta, pursuant to Resolution No. 84-14, shall in any way be spent or disbursed to or for the benefit of elementary or secondary school? located within the jurisdictional boundaries or sphere of influence of the City of Indio, unless and until the City of Indio establishes a policy similar to Resolution No. 84-14 BIB] 05-03-1996-U01 01:39:26PM-U01 CCRES-U02 84-U02 70-U02 ) 2 The City Clerk is hereby directed to transmit a copy of this resolution to the Desert Sands Unified School District, the County of Riverside, and the cities of Indian Wells, Palm Desert?
