ORD 11511 NO. 115 AN ORDINANCE OF THE CITY OF LA QUINTA AMENDING TITLE 8 ENTITLED "BUILDING AND CONSTRUCTION", AMENDING EXISTING BUILDING AND CONSTRUCTION, AND ADOPTING, BY REFERENCE, THE UNIFORM FIRE CODE, 1985 EDITION, INCLUDING CERTAIN SPECIFIED APPENDICES AND THE UNIFORM FIRE CODE STANDARDS, PUBLISHED BY THE WESTERN FIRE CHIEFS ASSOCIATION AND THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS. The City council of the City of La Quints, California does ordain as follows: SECTION 1. ADOPTION OF THE 1985 EDITION OF THE UNIFORM FIRE CODE. The �- following edition of the uniform code is adopted by reference in place of its respective code which is currently in effect. Title 8 is hereby revised to show the adoption of the following uniform code: The Unform Fire Code, 1985 Edition, including certain specified appendices and the Uniform Fire Code Standards, published by the Western Fire Chiefs Association and the International Conference of Building Officials. SECTION 2. OTHER REVISION 2. OTHER REVISIONS TO TITLE 8. Certain documents marked and designated as the "Uniform Fire Code, 1985 Edition", including Appendix I -A Life Safety Requirements For Existing Buildings other Than High Rise, I-B Life Safety Requirements for Existing High Rise, I-C Stairway Identification, II -A Suppression and Control of Hazardous Fire Areas, II-B Protection of Flammable or Combustible Liquids in Tanks in Locations That May Be Flooded, II-C Marinas, II-D Rifle Ranges, III -A Testing Fire Extinguishing Systems, Standpipes and Combination Systems, III-B Basement Pipe Inlets,. III-C Fire Alarm Systems, IV -A Interior Floor Finish, V-A Emergency Relief Venting for Fire Exposure for Aboveground Tanks, VI-B Model Citation Program, VI-C Reference Tables from the Uniform Building Code, VI-D Unit Conversion. Tables, and the "Uniform Fire Code Standards, 1985 Edition", are adopted for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion. . Each and all of the regulations, provisions, conditions and terms of "r such "Uniform Fire Code, 1985 Edition" and the "Uniform Fire Code Standards, 1985 Edition", published by the Western Fire Chiefs Association and the International Conference of Building Officials, on file in the City Clerk's office, are referred to and made a part of this Code as if fully set out in this Chapter, except as otherwise provide in this chapter. 8.08.020 Definitions. Section 9.102 "Definitions" of the "Uniform Fire Code, 1985 Edition", is amended by the addition of the following: A. Wherever the term "jurisdiction" is used in the "Uniform Fire Code", it shall be held to mean the City of La Quinta. B. Wherever the term "Corporation Council" is used in the "Uniform Fire Code", it shall be held to mean the City Attorney for the City of La Quinta. C. Wherever the title "Chief of Bureau of Fire Prevention" or "Chief" is used in the "Uniform Fire Code", it shall be held to mean the Chief of the Fire Department, serving the City of La Quints, and such other persons as he shall appoint to enforce the terms of the "Uniform Fire Code". 8.08.030 Violation Penalty. Any person who violates or fails to comply with any of the provisions of the "Uniform Fire Code": and this chapter or who fails to comply with any order made thereunder, or who builds in violation of any detailed statement or specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder from which no appeal has been taken, or who fails to comply with such an order as affirmed or modified after appeal, within the required time, ORDBLDGF.IRE . Page 3. is severally for each such violation and noncompliance guilty of a misdemeanor, punishable by a fine of not more than one thousand dollars or by imprisonment in the Riverside County Jail for not more than six months or by both such fine and imprisonment. Each person is guilty of a separate offense for each day or portion thereof during which any violation of any provision of the "Uniform Fire Code" and this Chapter is committed, continued, or permitted by such person after notification of the initial violation and shall be punishable therefore as provided herein. The application of the penalty provided in this Section shall not be held to prevent the abatement of prohibited conditions as a public nuisance as provided by Section 1.01.250 of the La Quinta Municipal Code. 8.08.040 Deletion of Certain Parts of the Uniform Fire Code. The following portions of the "Uniform Fire Code, 1985", are hereby deleted: Section 2.302 (Board of Appeals). 8.08.050 Board of Appeals. Section 2.302 (Board of Appeals) of the "Uniform Fire Code, 1985 Edition", is deleted. Hereinafter whenever the chief or his duly authorized representative disapproves an application or refuses to grant a permit or certificate applied for, or suspends or revokes any permit or certificate issued under. the "Uniform Fire Code", or when it is claimed that the provisions of the "Uniform Fire Code", do not apply or that the true intent and meaning of the "Uniform Fire Code", have been misconstrued or wrongly interpreted, any persons so aggrieved may appeal the decision of the Chief, to the City Council of the City of La Quinta. Any such appeal shall be governed by the provisions of Section ORDBLDGF.IRE • Page 4. 2.04.100 through 2.04.130 of the City of La Quinta Municipal Code. 8.08.060 Additional Permits Requested. Section 4.101 (Permits Required) of the "Uniform Fire Code" is amended by adding the following: "48. Controlled access devices: To install, use, maintain or operate any gate, barricade, or other similar device that is designed to restrict the entry, primarily of vehicles, onto private property. 49. Aircraft Operations: To take off or land any motorized type of aircraft at other than an approved flight facility or for emergency purposes." 8.08.070 Fire Apparatus Access Roads. Subsection (d) of Section 10.207 of the "Uniform Fire Code, 1985 Edition" is amended by adding the following: For the purpose of this section,"All weather driving surfaces" shall mean a hard surface such as asphalt, concrete, turf block or other hard surface as approved by the chief or the fire department. Section 10.207 of the "Uniform Fire Code, 1985 Edition" is amended by adding the following: (m) Controlled access. Whenever -access into private property, other than individual single-family residence, is controlled through the use of gates, barriers, guard houses or other similar means, provision shall be made to facilitate access by fire apparatus in a manner approved by the Fire Chief. All controlled access devices that are power operated shall ORDBLDGF.IRE Page 5. have a radio controlled override system capable of opening the gate when activated by a special transmitter, located in emergency vehicles. Devices shall be equipped to facilitate opening in the event of a power failure. All controlled access devices that are not power operated shall be approved by the Fire Chief. 8.08.080 Installation and Maintenance of Fire Protection, Life Safety Systems and Apppliances. Subsection (C) of Section 10.301 of the "Uniform Fire Code, 1985 Edition", is amended to read as follows: (C) Water Supply. In areas of commercial, industrial or multi- family development, an approved water supply capable of supplying required fire flow for fire protection shall be provided to all premises upon which buildings are hereafter constructed. When any portion of the building protected is in excess of 165 feet from an approved water supply on a public street, there shall be provided, when required by the Chief, on -site fire hydrants and mains capable of supplying the required fire flow. In areas of new single-family sub -divisions, an approved water supply capable of supplying required fire flow for fire protection, shall be provided to all premises; in no case shall the distance from a single-family residential lot to an approved water supply on a public street be in excess of 165 feet. Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mains or other fixed system capable of supplying the required fire flow. In setting such requirements for fire flow in connection with new developments involving industrial, commercial, multi -family or residential sub -divisions, the Chief ORDBLDGF.IRE Page 6. may be guided by the standard published by the Insurance Services Office, "Guide for Determination of Required Fire Flow". In setting such requirements, the following shall apply: 1. (a) In all single family residential zones, the minimum fire protection requirements shall be, that the fire flow facility shall be capable of supplying not less than 1000 gpm for two hours duration at 20 psi residual operating pressure. This portion of this ordinance shall be effective at such time as - the emergency water lines are installed. (b) All new subdivisions for single family residential development shall construct the required fire flow facility. The Chief may reduce such fire flow requirements on the condition that there be installed in each dwelling unit an approved automatic fire sprinkler system meeting the standards prescribed by National Fire Protection Association Standard 13D on file in the office of the City Clerk, with any amendments thereto which may have been adopted by the City. 2. (a) In all multiple family residential zones, the minimum fire protection requirements shall not be less than 2,500 GPM for 2 hours duration at 20 PSI residual operating pressure at any given hydrant. (b) All developments with five or more units on a legal lot or parcel of record shall be required to construct the fire flow facility. (c) In any subdivision of land in any residential zone where the potential is for five or more dwelling units, the fire flow facility shall be constructed as required Page. 7... ORDBLDGF.IRE in that zone. (d) For commercial and industrial buildings, the minimum fire flow required shall be 3,000 GPM at 20 PSI residual operating pressure for a 2 hour duration. The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises to be protected as required and approved by the Chief. All hydrants shall be accessible to the fire department apparatus by roadways meeting the requirements of Section 10.207. Subsections (f) and (g) are added to Section 10.301 of the "Uniform Fire Code, 1985 Edition", to read as follows: (f) Smoke Detectors. Smoke detectors approved by the State Fire Marshal shall be installed in all existing dwelling units by January 1, 1989. Dwelling units include, but are not limited to, single-family dwellings, duplexes, apartments, townhouses, condominiums, motels, and factory -built housing units. (g) In new construction of Group Rl and R3 or when alterations, repairs or additions requiring a permit and having a valuation in excess of $1,000 occur, or when one or more sleeping rooms are added or created in existing Group R, Division 3 occupancies, the entire building shall be provided with smoke detectors located as required for new Group R, Division 1 or Division 3 occupancies. The required smoke detectors shall receive their primary power from the building wiring when such wiring is served from ORDBLDGF.IRE Page 8. f a commercial source. Wiring shall be permanent and without "- a disconnecting switch other than those required for over current protection. The required smoke detector shall also be equipped with backup battery system that will allow the detector to remain operational in the event of a power failure. The responsibility for compliance with these subsections (f) and (g) and for maintenance of the smoke detectors shall rest with the owner of the dwelling(s). 8.08.090 Automatic Fire Extinguishing Systems. Subsection (b) of Section 10.308 of the "Uniform Fire Code, 1985 Edition", is amended by adding the following: An approved automatic fire sprinkler system shall be installed in every building hereafter constructed for Group A, B, E, H, I, and R1 occupancies where the gross floor area is 5,000 square feet or more, regardless of stories. Fire resistive walls shall not be considered for reducing the gross floor area of the building for the purposes of this code section, nor does this section lessen a more stringent requirement contained elsewhere in this code. For the purposes of this Code Section, R1 occupancies, are limited to hotels, motels, and apartment buildings. NFPA Standard No. 13D Life Safety System may be installed in Group R, Division 1 occupancies larger than 5,000 square feet in lieu of normal commercial NFPA Standard No. 13 Fire Suppression Systems. For the purpose of this Code Section, Group R, Division 1 occupancies with 4 or more attached dwelling or guest units shall have an automatic fire sprinkler system installed. Automatic fire sprinklers shall ORDBLDGF.IRE Page 9. AI - be installed in all building over two stories in height or exceeding thirty (30) feet in height. 8.08.100 Standpipes. Subsection (b) of Section 10.311 of the "Uniform Fire Code, 1985 Edition", is amended by adding the following: (b) Where required. Standpipe systems shall be provided as set forth in Table No. 10.311. Such standpipe systems shall be provided with fire department inlet connections at accessible locations adjacent to usable stairs, but in no case shall the distance from the curb line to fire department standpipe connection exceed forty (40) feet. Subsection (f) is added to Section 10.311 of the "Uniform Fire Code, 1985 Edition", to read as follows: (f) Replacement. Occupancies having an existing wet standpipe system which has been determined by the Chief to need replacement, shall be required to replace the hose and nozzle appliances with lined hose tested to 300 PSI and variable fog nozzle. 8.08.110 Exit Obstruction. Subsection (f) is added to Section 12.103 of the "Uniform Fire Code, 1985 Edition", to read as follows: (f) Windows of Sleeping Rooms. Any bars, grates or other obstructions across the opening of any window of any sleeping room of any building shall be so constructed that they may be readily opened so as to allow an occupant to use the window to -as a means of escape from a fire originating within the building. 8.08.120 Multi -Plug Adaptors. Section 85..07 of the "Uniform Fire Code, 1985 Edition", is amended to read as follows: ORDBLDGF.IRE Page 10. v The use of multiplug adaptors such as multi -plug extension cords, cube adaptors, strip plugs or any other device that does not comply with this code or the electrical code is prohibited. U.L. approved multi -adaptor outlet boxes which are enclosed in cases and have a build -in 15 ampere circuit breaker may be utilized, provided the other provisions of the Section are met. 8.08.130 Buildings Under Construction. Subsection (d) of Section 87.103 is amended to read as follows: 3. Where required. Every building three (3) stories or more in height shall be provided with not less than one standpipe for use during construction. Such standpipe shall be provided with fire department hose connections at accessible locations adjacent to usable stairs and the standpipe outlets shall be located adjacent to such usable stairs. Such standpipe systems shall be extended as construction progresses to within one floor of the highest point of construction having secured decking or flooring. In each floor there shall be provided a 2 1/2 inch valved outlet for fire department use. Where construction height requires installation of a Class III standpipe, fire pumps, and water main connections shall be provided to serve the standpipe. Subsection (d) of Section 87.103 is amended by adding the following: 5. First Aid Suppression. Every building less than three (3) stories in height shall have domestic water supply ORDBLDGF.IRE Page 11. available on site and garden hose installed which will reach all portions of the combustible construction areas, the purpose of which is to provide "first aid" fire suppression. SECTION 3. VIOLATIONS AND PENALTIES. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, or improve, remove convert, or demolish, equip, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this Ordinance. Any person, firm, or corporation violating, or failing to comply with, any of the provisions of such Ordinance or Code shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provision of such Code is committed, continued, or permitted, and upon conviction of any such violation, such person shall be punishable by a fine of not more than $500 or by imprisonment for not more than six months or by both such fine and imprisonment. The application of the penalty provided in this section shall not be held to prevent the abatement of prohibited conditions as a public nuisance as provided by Section 1.01.250 of the La Quinta Municipal Code. SECTION 4. VALIDITY. If any section, subsection,-Clause,"ox-phrase.-of this Ordinance, or of any code adopted thereby is for any reason held by a court of competent jurisdiction to be invalid, such a decision shall not affect the validity of the remaining portions of this Ordinance or of any code adopted thereby. The City Council hereby declares that it Would have 11 passed this Ordinance and each section or subsection, sentence, clause and phrase thereof, and of each code adopted hereby irrespective of the clauses or phrases being declared invalid. ORDBLDGF.IRE Page 12. I- SECTION 5. EFFECTIVE DATE. This Ordinance shall be in full force V. and effect thirty (30) days after its adoption. SECTION 6. POSTING. The City Clerk shall, within 15 days after passage of this Ordinance, cause it to be posted in at least three public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and it's certification together with proof of posting, to be entered in the Book of Ordinances of this City.
