RDA Resolution 1989-20 RESOLUTION NO. RA 89-20 RESOLUTION OF THE LA QUINTA REDEVELOPZENT AGENCY APPROVING PROCEDURE TO IMPLEMENT OWNER PARTICIPATION RULES AND DESIGNATED AREA FROM WHICH IT DESIRES TO TO RECEIVE PROPOSALS WHEREAS, the La Quinta Redevelopment Agency the Agency") is carrying out the Redevelopment Plan the Plan") for La Quinta Redevelopment Project No. 1 the Project"); and WHEREAS, the Agency has adopted Rules Governing Owner Participation and Business Re-Entry the Participation Rules") pertaining to the redevelopment of the Project Area for the Project; and WHEREAS, the Agency desires to approve certain procedures to implement such Participation Rules in the form attached as Exhibit A": hereto and incorporated herein by reference the Procedures"); and WHEREAS, the Agency desires to designate as a Limited Area" for the receipt of redevelopment proposals, as more fully set forth in the Procedures, that action area described in Exhibit B" and incorporated herein by reference the Subject Area"); NOW, THEREFORE, the La Quinta Redevelopment Agency hereby resolves as follows: 1. The Agency approves and adopts the Procedures. 2. Based upon the staff report presented in connection herewith, as well as further evidence presented, the Agency designates the Subject Area as a Limited Area", within the meaning of the Procedures, and authorizes and directs the Executive Director to elicit proposals and implement the Procedures in respect to the Subject Area. The Executive Director shall allow a period of up to three 3) weeks tor the submittal of proposals, and shall so notify all owners of record of real property within the Subject Area. Background. The La Quinta Redevelopment Agency the Agency") by Ordinance No. 43 established the La Quinta Redevelopment Project the Redevelopment Project") The Agency, in connection with the Redevelopment Project, has adopted Rules Governing Owner Participation and Business Re-Entry the Participation Rules"). The La Quinta Redevelopment Agency desires to set forth procedures and criteria for the eliciting and consideration of proposals for participation by owners within certain portions of the Project Area as may hereafter be designated from time to time such area constituting a Limited Area") The Agency now desires to more fully set forth procedures and criteria for the evaluazion of submittals made by owners and/or tenants interested in participating in some manner in such Limited Area(s) as the Agency may hereafter designate from time to timZ by Resolution. II. Procedure, Upon receipt of requests for consideration by owners or tenants from within a Limited Area with respect to owner participation and/or reentry of business within the Project Area, the Agency will review such submittals. a) Upon receipt of submittals, initial evaluation shall be conducted by the Executive Director or Deputy Executive Director) of the Agency. Each party making a submittal is responsible for the completeness and accuracy of its submittals. If requested by the Agency's Executive Director or Deputy), submittals shall include a construction pro forma if applicable), an operating pro forma, and a business plan. In the event the Executive Director or Deputy) notifies a party making a submittal that the submittal is incomplete or that additional information is required. such party shall be allowed three 3) weeks to complete its submittal. The Zailure to timely provide such additional information of the submittal. and consideration of such submittal shall thereupon cease. Upon receipt of one or more submittals and additional information as applicable, the Executive Director or Deputy) will evaluate the submittal and make a determination with respect to whether the submittal or submittals, as applicable) conforms to the criteria set forth in paragraph C-i below, In the event a party having made a submittal disagrees with conclusions reached by the Executive BIB] 03-04-1997-U01 02:15:21PM-U01 RDARES-U02 89-U02 20-U02 RESOLUTION NO RA 89-20 DirectorZ Zuch party may appeal such decision to the governing board of the Agency by making written request therefor within ten 10) days after the Executive Director or Deputy) transmits notice of the initial evaluation. The review of such- submittal(s) by the Agency shall be de novo. b) Any decision by the Executive Director or Deputy) resolving a conflict between submittals may be appealed for de novo review by the governing body of the Agency) by an affected party by making written request therefor within ten 10) days after the Executive Director or Deputy) transmits notice of his decision. c) Criteria. 1. The following criteria shall be applied in reviewing submitta ls: a. Conformity of the submittal including with respect to uses) with the Redevelopment Plan and other applicable enactments; b. Zeasibility of the proposal; C. Successful development experience; d. Zinancia1 capability; e. Manufacturer or franchise approval if applicable), including a) present commitment of such approvalZ b) past history of having obtained such approval, or c) facts demonstrating a reasonable probability that such approval will be given; and f* Experience in operating the use(s) proposed The foregoing may be satisfied by the submitting party itself, or by a partner or joint venturer; any such partner or joint venturer must be identified at the time of submittal and must approve/authorize its involvement in such proposed partnership or joint venture. 10-25-89 BIB] 03-04-1997-U01 02:15:21PM-U01 RDARES-U02 89-U02 20-U02 RESOLUTION NO RA 89-20 2. In the event conZlicting submittals are received which satisfy the criteria set forth in paragraph Cl above, the following criteria shall be applied to resolve such conflict: a. Which submittal best satisfies the criteria set forth in paragraph Cl; b. Sales tax generation reasonably anticipated; C. Employment generation; d. Environmental benefits or lesser degree of detrimental impact); e. Degree to which assistance souZht; f. Degree of site control by party making the submittal; and g. Value of existing properZy land and improvements) within the Limited Area by the party making submittal. XII. Amendment.
