RDA Resolution 1991-07 RESOLUTION NO. RA 91-7 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA APPROVING THE REVISIONS TO THE ASSESSMENT/HOOK-UP FEE SUBSIDY PROGRAM FOR THE FURNISHING OF ASSISTANCE FOR AFFORDABLE HOUSING WHEREAS, the La Quinta Redevelopment Agency the Agency") is in the process of implementing the Redevelopment Plans the Plans") for Redevelopment Project Area No. 1 as adopted by City of La Quinta Ordinance No. 34 and Redevelopment Project Area No.2 as adopted by City of La Quinta Ordinance No. 139 the Project Areas"); and WHEREAS, the Plans for the Project Areas provide that certain funds are to be made available to improve and expand the supply of low and moderate income housing conformity with the provisions of Section 33334.2 of the California Health and Safety*ty Code; and WHEREAS, the Plans provide for the provision by the Agency of certain public improvements; and WHEREAS, the City of La Quinta the City") has established and implemented four Assessment Districts the Districts"), which will provide certain sewer and related infrastructure improvements the Improvements") of benefit to residents of the Project Areas; and WHEREAS, the Agency currently implements an Assessment/Hook-Up Fee Subsidy Program the Program") which provides assistance to defray the cost of the assessment and sewer connection fees by the Districts for the benefit of persons who qualify due to income or who covenant to provide affordable housing for a fifteen-year period; and WHEREAS, it is necessary to make certain modifications to the Program by incorporating a requirement for a Deed of Trust and Promissory Note which are attached hereto as Exhibit A and to the Statement of the La Quinta Redevelopment Agency Assessment/Hook-Up Fee Subsidy Program the Statement"), which is attached hereto as Exhibit B", and which are all incorporated herein by reference; and WHEREAS, the continued provision of the Improvements will benefit the Project Areas and there is no other reasonable means available to the community to finance the Improvements; and WHEREAS, the City Council desires to ratify the Program. NOW, THEREFORE, the City Council of the City of La Quinta does resolve as follows: 1. The above recitals are true and Correct. The City Council finds and determines that: a) the provision of the Improvements will benefit the Project Areas; b) the Improvements directly and * specifically improve or increase the community's supply of low or moderate income housing; C) there is available to the community no other reasonable means of financing the Improvements than that set forth in the Statement, d) the Program is currently being implemented, and e) the modifications are necessary to the continued success of the Program. 3. The City Council approves and adopts the revisions to the Program as described in the above recitals and further ratifies the Program as modified.
