ORD 193ORDINANCE NO, 193
AN ORDINANCE OF THE CITY OF LA QUINTA,
CALIFORNIA, AMENDING CHAPTER 1.44 TO
THE LA QUINTA MUNICIPAL CODE
WHEREAS, mining operations are permitted in only one zone
in the City of La Quinta ("City"), namely the Watercourse,
Watershed and Conservation Areas (W-1) Zone; and
WHEREAS, the City Council of the City has determined that
mining operations are not appropriate uses in the W-1 Zone; and
WHEREAS, the City Council of the City does not intend by
this ordinance to violate or affect in any way the provisions
of the California Surface Mining and Reclamation Act of :9'75,
California Public Resources Code Section 2710, et sec., as such
Act may apply to any lands within the City.
NOW, THEREFORE, the City Council of the City of La Quinta,
California, does hereby ordain as follows:
Section 1. Chapter 9.144, Section 9.144.020(B)(2) is
hereby deleted.
Section 2. The City Clerk shall certify to the passage and
adoption of this ordinance and shall cause it to be posted or
published in the manner required by law.
