ORD 216ORDINANCE NO. 216 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, AMENDING THE LA QUINTA MUNICIPAL CODE BY ADDING SECTION 9.224.030 RELATING TO THE FEES CHARGED FOR NON-PROFIT ORGANIZATIONS CASE NO. ZONING ORDINANCE AMENDMENT 92-028 CITY OF LA QUINTA WHEREAS, Chapter 9.216 of the La Quinta Municipal Code requires the promoter of a minor outdoor event to obtain a permit from the City prior to conducting such event; and WHEREAS, the City has established a fee for the issuance of a permit for a minor outdoor event; and WHEREAS, nonprofit groups from time to time hold minor outdoor events within the City of La Quinta for purposes related to the charitable, educational, cultural or other authorized purposes of those groups; and WHEREAS, the City Council finds that the imposition of a permit fee on nonprofit groups creates a burden on such groups and in some cases prevents nonprofit groups from holding minor outdoor events; and WHEREAS, the City Council finds that minor outdoor events conducted by nonprofit groups provide cultural, educational and charitable experiences and benefits to the people of the City; and WHEREAS, the City Council finds that eliminating the minor outdoor event permit fee for nonprofit groups would encourage such groups to conduct events of benefit to the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: There is hereby added to the La Quinta Municipal Code Section 9.224.030, which is to read as follows: ORDDRFT.020 1 Ordinance No. 216 Section 9.224.030 Nonprofit Organizations Nonprofit organizations are exempt from paying the fees charged for the processing of a Minor Outdoor Event application per Chapter 9.216. For the purposes of this Section, "Nonprofit Organization" shall mean a corporation, association or other organization which is exempt from taxation under Section 501(C)(3) of the Internal Revenue Code and Section 23701(d) of the California Revenue and Taxation Code, and which has received determination letters from the United States Internal Revenue Service and the California Franchise Tax Board confirming its exempt status under such sections. SECTION 2: ENVIRONMENTAL. This Ordinance has complied with the requirements of "The Rules to Implement the California Environmental Quality Act of 1970" (County of Riverside, Resolution 82-213, adopted by reference in City of La Quinta Ordinance 5), in that the Planning Director conducted an initial study and has determined that the proposed amendment will not have a significant adverse impact on the environment and a Negative Declaration is hereby adopted. SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) days after its adoption. SECTION 4. POSTING. The City Clerk shall, within 15 days after passage of this Ordinance, cause it to be posted in at least three public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting, to be entered into the Book of Ordinances of this City.
