ORD 233ORDINANCE 233 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, AMENDING CHAPTER 9.145 - HC (HILLSIDE CONSERVATION ZONE) OF THE LA QUINTA MUNICIPAL CODE. CASE NO.: ZOA 93-034 - CITY OF LA QUINTA The City Council of the City of La Quinta does ordain as follows: SECTION 1. Section 4.1 of Riverside County Ordinance 348 (which was adopted by reference by this City Council by Ordinance 5, operative August 29, 1982), as amended, is further amended as stated in Exhibit W. SECTION 2. ENVIRONMENTAL. The Zoning Ordinance Amendment has complied with requirements of "The Rules to Implement the California Environmental Quality Act of 1970" (as amended and adopted in City Council Resolution 83-68), in that the Planning Director conducted an initial Study and has determined that the proposed amendment will not have a significant adverse impact on the environment, and that a Negative Declaration of Environmental Impact should be adopted. SECTION 3. EFFECTIVE DATE. This Ordinance shall be in full force and effect thirty (30) days after its adoption. SECTION 4. POSTING. The City Clerk shall, within 15 days after passage of this Ordinance, cause it to be posted in at least three public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and it's certification, together with proof of posting to be entered into the Book of Ordinances of the City of La Quinta. ENA, ayor City of La Quinta, California T T a ORDINANCE NO. 233 Exhibit "A" ZONING ORDINANCE AMENDMENT 93-034 Section 9.145.055 (Division of H-C Zoned lands) is hereby amended as follows: "In order to assure compliance with the provisions of this Chapter there shall be submitted for every property within or partially within H-C Zoned land, along with every conditional use permit, tentative subdivision map or parcel map filed for approval, in accordance with teh provisions of Title 13 of this Code, a preliminary grading plan (and other requirements of this Chapter) showing at least one practical, usable, accessible building site which can be developed in accordance with the provisions of this Chapter for each lot or parcel." Section 9.145.060 (Transfer of Development Rights) is hereby amended as follows: Section 9.145.060(C)1, is to read as follows: "A subdivided portion of the same property below 'the toe of the slope' as presented in a conditional use permit; or," Section 9.145.060(C)2, is hereby amended as follows: "By means of sale to any area of the City which has been zoned for residential purposes, provided the increase for any particular parcel does not exceed 20 % of the General Plan density designation.
