ORD 254ORDINANCE NO. 254 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, AMENDING SECTION 3.24.020(A) OF THE LA QUINTA MUNICIPAL CODE RELATING TO TRANSIENT OCCUPANCY TAX WHEREAS, the City Council of the City of La Quinta recognizes short-term space rental at recreation vehicle resorts to meet the Transient Occupancy Tax payment requirements; and WHEREAS, the City Council of the City of La Quinta desires to add recreation vehicle resorts to the current Transient Occupancy Tax Ordinance. NOW, THEREFORE, THE LA QUINTA CITY COUNCIL DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1: That Title 3, Chapter 3.24, Section 3.24.020(a) is hereby amended to read as follows: "DEFINITIONS: Except where the contest otherwise requires, the definitions given in this section shall govern the construction of this chapter: "A. "Hotel" means any structure, or any portion of any structure, which is occupied or intended or designed for use or occupancy by transients, including but not limited to dwelling, lodging or sleeping purposes, and includes any hotel, inn, tourist home or house, motel, studio hotel, bachelor hotel, lodginghouse, roominghouse, apartment house, time-share project or facility, dormitory, public or private club, rental space for recreation vehicles, mobile homes or house trailer at a fixed location, or other similar structure or portion thereof, duplex, triplex, single-family dwelling units except any private dwelling house or other individually owned single- family dwelling house unit rented only occasionally (infrequently) and incidentally to the normal occupancy by the owner or his family; provided that the burden of establishing that the housing or facility is a hotel as defined in this subsection shall be upon the owner or operator thereof who shall file with the tax administrator such information as the tax administrator may require, to establish and maintain such status." SECTION 2: EFFECTIVE DATE: This Ordinance shall be in full force and effect thirty (30) days after its adoption. Ordinance No. 254 SECTION 3: POSTING: The City Clerk shall within 15 days after passage of this Ordinance, cause it to be posed in at least three public places designated by resolution of the City Council; shall certify to the adoption and posting of this Ordinance; and shall cause this Ordinance and its certification, together with proof of posting to be entered into the book of Ordinances of the City of La Quinta.
