ORD 273ORDINANCE NO. 273 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA AMENDING TITLE 8.11 OF THE MUNICIPAL CODE WHEREAS the City of La Quinta has previously enacted Title 8.11 of the Municipal Code, "Flood Hazard Regulations", to enable property owners with property located in special flood hazard areas the opportunity to acquire flood insurance, and WHEREAS flood control improvements have been constructed within the City that reduce the risk of flood hazard to certain special flood hazard areas identified on the original Flood Insurance Rate Map prepared for La Quinta in 1984, and WHEREAS the Federal Emergency Management Agency has prepared a new Flood Insurance Study that acknowledges the new flood control improvements constructed in the mid-1980's, and WHEREAS the Federal Emergency Management Agency has published a new Flood Insurance Rate Map, dated August 19, 1991, pursuant to its latest Flood Insurance Study, and WHEREAS the existing language of Title 8.11 does not reference the latest Flood Insurance Study and attending Flood Insurance Rate Map, NOW, THEREFORE, the City Council of the City of La Quinta, California does ordain as follows: SECTION 1. City of La Quinta Municipal Code Title 8.11 is hereby amended as follows: 1) Replace all of Section 8.11.030.B "Basis for Establishing the Areas of Special Flood Hazard", with the new ordinance language provided on Exhibit "A" attached hereto. SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force and effect thirty (30) days after its adoption. SECTION 3. POSTING. The City Clerk shall, within 15 day;Ufter passage of this ordinance, cause it to be posted in at least three public places designated by resolution of the City Council; shall certify to the adopton and posting of this ordinance; and, shall cause this ordinance and its certification, together with proof of posting, to be entered in the Book of Ordinances of this City. B. Basis for Establishing the Areas of Special Flood Hazard. The areas of special flood hazard identified by the Federal Insurance Administration of the Federal Emergency Management Agency in the Flood Insurance Study, dated August 19, 1991, and accompanying Flood Insurance Rate Map, dated August 19, 1991, and all subsequent amendments and/or revisions are hereby adopted by reference and declared to be a part of this chapter. This Flood Insurance Study, with its attendant mapping, is the minimum area of applicability of this chapter and may be supplemented by studies for other areas that allow implementation of this chapter and are recommended to the City Council by the floodplain administrator. The Flood Insurance Study, and the Flood Insurance Rate Map are on file in the Office of the City Engineer at 78-495 Calle Tampico, La Quinta. STATE OF CALIFORNIA ) COUNTY OF RIVERSIDE) ss.
