ORD 287ORDINANCE NO. 287 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, AMENDING TITLE 2, CHAPTERS 2.06, 2.29, 2.65, 2.70, 2.80, 2.85, 2.90; TITLE 7, CHAPTER 7.04; TITLE 9, REVOKING CHAPTER 9.12 WHEREAS, Chapters 2.06, 2.29, 2.65, 2.70, 2.80, 2.85, 2.90, 7.04, and 9.12 of the La Quinta Municipal Code ( the "Code") sets forth general rules relating to commissions, boards and committees in the City of La Quinta (the "City"); and WHEREAS, Chapter 2.06 of the Code sets forth general rules for all commissions, boards and committees; and WHEREAS, the City desires to standardize certain general rule and/or characteristics for all commissions, boards and committees by combining them under Chapter 2.06 and striking their references, as appropriate, in the other chapters; and WHEREAS, Chapter 9.12 of the Code contains references to the Planning Commission that already are, or could be placed in Chapter 2.29 of the Code that also covers the Planning Commission and that Chapter 9.12 contains references to Planning Area Councils and the City Council appointment of a Planning Director which are no longer relevant; and WHEREAS, the City believes that these changes will facilitate an easier and more comprehensive understanding of the City's commissions, boards, and committees; and WHEREAS, the City believes that these changes are in the best interests of the citizens of the City of La Quinta. NOW, THEREFORE, the City Council of the City of La Quinta does ordain as follows: Section 1. Amend the La Quinta Municipal Code as follows: ADD THE FOLLOWING SECTIONS TO CHAPTER 2.06 OF THE CODE: "2.06.020 General Rules regarding appointments, terms, and vacancies. Ordinance No. 287 Page 2 D. Unless otherwise provided by law, ordinance, or resolution of the City Council, all members of boards, commissions, and committees of the City shall serve on only one board, commission, or committee at any given time in order to avoid simultaneous memberships. 2.06.040 Quorum. Unless otherwise provided by law, ordinance, or resolution of the City Council, a quorum for each board, commission, or committee shall be the majority of existing, appointed members. 2.06.050 Compensation. Compensation for boards, commissions, or committees shall be as set by resolution of the City Council. 2.06.060 Meetings. Unless otherwise provided by law, ordinance or resolution of the City Council, each board, commission or committee of the city shall meet once each month or as needed on the date(s) selected by the board, commission, or committee. Special meetings may be called by the chairperson or a majority of the board, commission, or committee in accordance with state law." AMEND CHAPTER 2.29 OF THE CODE AS FOLLOWS: Amend 2.29.010 Created by adding the following sentence to the end of the paragraph: "It is preferred, although not required, that members of the commission have expertise in the areas of architecture, landscape architecture, engineering, commercial art or graphic design." Delete 2.29.030 Meetings -Rules of procedure and replace with the following: "2.29.030 Rules of procedure. The commission shall follow such rules and regulations established by the City Council for the conduct of its business which shall comply with Section 65804 of the Planning and Zoning Law." Ordinance No. 287 Page 3 AMEND CHAPTER 2.65 OF THE CODE AS FOLLOWS: Amend 2.65.040 Formation and function of the Art in Public Places Commission as follows: "2.65.040 Formation and function of the Art in Public Places Commission. E. Commission Composition and Selection. The City Council establishes an Art in Public Places Commission (the "Commission") composed of seven members appointed directly by the City Council from the community. The Commission will submit to the City Council a recommendation for ratification of public art to be financed by the Art in Public Places Program and carry out the other functions described in this chapter." Delete 2.65.040(B.) Term of Committee. Delete 2.65.040 (C.) (5.) AMEND CHAPTER 2.70 OF THE CODE AS FOLLOWS: Delete 2.70.010(E.), 2.70.020(A) and 2.70.030 (A.) AMEND CHAPTER 2.80 OF THE CODE AS FOLLOWS: Delete 2.80.030 (B.),(C.), and (E), and 2.80.040 Officers -Selection, 2.80.060 Meetings, and 2.80.070 Removal from office. AMEND CHAPTER 2.85 OF THE CODE AS FOLLOWS: Amend 2.85.030 Members -Appointments -terms as follows: "2.85.030 Members -Appointments A. The commission shall consist of seven members appointed by the City Council. B. Every effort will be made to ensure that a wide cross- section of social and leisure services, interests and viewpoints, including providers, recipients and professionally related occupations, are represented. Membership may include representation from all organized cultural organizations of La Quinta, both public and private. Ordinance No. 287 Page 4 Delete 2.85.040 Officers -Selection, 2.85.060 Meetings, and 2.85.070 Removal from office. AMEND CHAPTER 2.90 OF THE CODE AS FOLLOWS: Amend 2.90.030 Members -Appointments -Terms as follows: "2.90.030 Members -Appointments. A. The Commission shall consist of seven members appointed by the Council. B. Every effort will be made to ensure that a wide cross- section of community residents, interests and viewpoints, including providers, recipients and professionally related occupations are represented. Community service organizations such as law enforcement, recreation, public health, gang prevention, child care, fair housing and senior services, for example, shall be represented. Delete 2.90.040 Officers -Selection, 2.90.060 Meetings, and 2.90.070 Removal from office. Amend 2.90.080 (B.) as follows: "B. Address issues such as child care, senior citizens needs, cultural diversity, public health, gangs and violence;" AMEND CHAPTER 7.04 OF THE CODE AS FOLLOWS: Amend 7.04.020 Appointment as follows: Delete 7.04.020 (B.), (C.), (D.), (E.), and (F.) Delete 7.04.040 Organization, rules and procedures REVOKE CHAPTER 9.12 OF THE CODE IN ITS ENTIRETY Section 2. EFFECTIVE DATE: This Ordinance shall be in full force and effect thirty (30) days after its adoption. Ordinance No. 287 Page 5 Section 3. POSTING: The City Clerk shall cause this Ordinance to be posted in at least three public places designated by resolution of the City Council, shall certify to the adoption and posting of this Ordinance, and shall cause this Ordinance and its certification, together with proof of posting to be entered into the Book of Ordinances of the City of La Quinta.
