ORD 351ORDINANCE NO. 351 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA APPROVING A ZONE CHANGE FROM TOURIST COMMERCIAL TO A LOW DENSITY RESIDENTIAL DESIGNATION ON 73 ACRES LOCATED AT THE SOUTHWEST CORNER OF 50TH AVENUE AND JEFFERSON STREET CASE NO.: ZONE CHANGE 2000-094 RJT HOMES, LLC WHEREAS, the City Council of the City of La Quinta, California, did on the 21 st day of November , 2000, hold a duly noticed Public Hearing for RJT Homes, LLC for review of a Zone Change to allow the zoning of 73 acres at the southwest corner of Avenue 50 and Jefferson Street to Low Density Residential; and WHEREAS, at said Public Hearings, upon hearing and considering all testimony and arguments, if any, of all interested persons wanting to be heard, said City Council did make the following mandatory findings recommending approval of said Zone Change: 1. The proposed project is consistent with the goals and policies of the La Quinta General Plan, and the Land Use Map for the General Plan in that less than four units per acre will be developed, ensuring land use compatibility. 2. The Zone Change will not be detrimental to the public health, safety and welfare, as it has been designed to be compatible with surrounding development, and conform with the City's standards and requirements. 3. The Zone Change is compatible with the City's Zoning Ordinance in that it supports the development of a range of housing in an integrated community. 4. The Zone Change supports the orderly development of the City. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of La Quinta, California that it does ordain as follows: SECTION 1. PURPOSE. To rezone a portion of land generally located at the southwest corner of 50th Avenue and Jefferson Street, more particularly described as APNs 772-050-007 and 772-050-008, from Tourist Commercial to Low Density Residential (RL). Ordinance No. 351 Change of Zone 2000-94 RJT Homes Adopted: December 5, 2000 Page 2 SECTION 2. ENVIRONMENTAL. This Zone Change has complied with the requirements of the CEQA (California Environmental Quality Act of 1970 as amended) and adopted by City Council Resolution 83-68, in that the Community Development Director has determined that the proposed Zone Change will not have a significant adverse impact on the environment. SECTION 3. EFFECTIVE DATE: This Ordinance shall be in full force and effect thirty (30) days after its adoption. SECTION 4: POSTING. The City Clerk shall certify to the passage and adoption of this Ordinance, and shall cause the same to be posted in at least three public places designated by Resolution of the City Council, and shall cause this Ordinance and its certification, together with proof of posting, to be entered into the Book of Ordinances of this City.
